200 Resolution re: Mrs. Esther B. Wayland for her Gift to the City Executive Session he felt the City can enforce this code compliance through its inspection program. Mrs. O'Brien stated she would like to have a staff response to the issues raised before the second reading of this ordinance. On motion ,by Mrs. O'Brien, seconded by Mr. Gatewood the following resolution was unanimously adopted. BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that the sum of $25,000 is hereby accepted as a gift from Esther B. Wayland and deaignated as revenue in the Capital Projects Fund; and BE IT FURTHER RESOLVED that the Council expresses to Mrs. Wayland its graditude for her generous donation to the City. On motion by Mrs, O'Brien, seconded by Mr. Albro that Council meet in executive session to discuss matters exempted by Section 2.1-~344(a)(1), 2.1~.344(a)(2) and 2.1~344(a)(6) of the Virginia Freedom of Information Act, waa adopted hy the following recorded vote. Ayes: Mr, Albro, Mr. Brunton, Mr. Buck, Mr. Gatewood and Mrs. O'Brien. Noes: None. On motion the meeting adjourned. COUNCIL CHAMBER ~ TUESDAY~ JANUARY 22, 1980 Regular Meeting Approval of minutes Presentation re: Frank Folsom Smith - McGuffey Housing and acceptance by Council The Council met in regular session on this date with the following members present: Mr. Albro, Mr. Brunton, Mr. Buck, Mr. Gatewood and Mrs. O'Brien. Absent: None. The minutes of the meetings of December 17, 1979 and January 7, 1980 were approved as presented. Mr. Frank Folsom Smith, addressed the Council and presented plans and drawings for the proposed condomini~nn project on the McGuffey Property as proposed for Phase I. He stated that they had secured ninteen reservations out of the twenty-one units in the. first Phase. He stated they hoped to be ready to sign firm sales contracts by March, site construction scheduled to be starting in April and building construction in May of this year. He stated he would like to separate Phase I and Phase II as far as the purchase of the land is concerned, but he would like to have a binding contract for purchase of the entire tract. He requested Council's approval of the plans and designs as presented. He also requested Council to approve changing the terms of his existing option to allow him to purchase the land on a binding contract but with closing in two phases. Closing on the first Phase would be prior to construction, at a price of $40,000, and the second Phase purchase would be closed within two years thereafter, at a price of $35,000.
