Request~ re: <br />JAUNT -.- <br />Appropriation <br />for $15,000 <br /> <br />Resolution re: <br />Authorizing the <br />City Atty. to <br />appeal the FERC <br />Decision in Docket <br />No. RP75-106 <br />(Natural Gas Rate <br />Case) <br /> <br /> 209 <br /> The Mayor thanked_ Mr. Lambertt-and granted a two week extension <br /> <br />on the report. <br /> <br /> Mr. Rick Seaman, Charlottesville's representative to the <br /> <br />JAUNT Board, addressed the Council and stated that there are some <br />items of which the Council should be aware relating to the <br />operations of JAUNT. He stated the Albemarle County Board of <br />Supervisors will consider authorizing the County Executive to sign <br />the labor warranty provision which has been holding up final <br />approval of JAUNT's Section 18 funding request. He stated this <br />means that ~aile JAUNT can be hopeful of receiving Section 18 <br />funds within the next 60 days an unfunded operating deficit must <br />still be covered for January, February and March, 1980. He stated <br />the JAUNT Board has instructed him to submit a request for an <br />appropriation of $15,000 to cover the Charlottesville share of <br />JAUNT's operating defiCit for the first three months of this year. <br />This request is in the same amount and subject to the same <br />restrictions as those funds appropriated for the period October <br />through December, 1979. He stated that JAUNT proposes that CTS <br />and JAUNT consider the feasibility of submitting a joint proposal <br />for the provision of public transit service in the Roune 29 North <br />corridor. He suggested that JAUNT'and CTS cooperate on a <br />coordinated approach wh~re CTS would serve the area from University <br />Hall to Rio Road and the JAUNT would serve the rural area from <br />Rio Road to the Greene County line. <br /> <br /> On motion by Mr~.~Buck, seconded by Mrs. O'Brien the following <br />resolution was offered and carried over to the next meeting for <br />consideration. <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottes- <br />ville, Virginia, that the sum of $15,000.00 is hereby appropriated <br />from the unappropriated balance of the General Fund to expenditure <br />account 01-92390 for the continued operation of transit services <br />within the City of Charlottesville by Jefferson Area United <br />Transportation, Inc. (JAUNT) from January 1, 1980 through <br />March 31, 1980. Such appropriation shall be upon the same terms <br />and conditions as were established by an appropriation resolution <br />adopted by this Council on November 19, 1979: <br /> <br /> Mr. Buck stated that before the second reading he would like <br />a report from the staff as to whether the City can sign the <br />warranty or if the County is going to sign, because if neither is <br />going to sign the warranty we will not be able to take advantage <br />of Section 18 funds, because this loan can not be repaid in <br />Section 18 funds are not forthcoming. <br /> <br /> On motion by Mrs'. O'Brien, seconded by Mr. Gatewood the <br />following resolution was unanimously adopted. <br /> <br /> WHEREAS, since 1975 the City has been an active <br />participant in a rate proceeding of Columbia Gas Transmission <br />Corporation, FERC Docket No. RP75-106 Consolidated Taxes), before <br />the Federal Energy Regulatory Commission, in which the City has <br />challenged the computation of the federal income tax component <br />of Co~umB~±a's cost of service and resulting rates for natural <br />gas purchased by the City; ~and <br /> <br /> WHEREAS, on July 2, 1979 the FERC issued Opinion No. 47 <br />in which, by a 3 to 2 vote, it reversed its own earlier announced <br />decision and the previous decision of its presiding administrative <br />law judge that had adopted the City's position in Docket No. <br />RP75-106; and <br /> <br /> <br />
