208 <br /> <br />Ordinance re: <br />Granting a franchise <br />to Multi-Channel <br />TV Cable Co. <br /> <br />Ordinance re: <br />Cable Communications <br />and CATV Systems <br /> <br />Progres Report re: <br />McIntire Road <br />Design Comm. <br /> <br />would be charged for the different services to he provided. <br /> Mr. Fred Landess representing Multi-Channel TV Cable Company <br />addressed the Council and stated that about a year and a half had <br />been spent in various stages of nsgotiation with the City in <br />regards to this ordinance and now have a document which doesn't <br />make anyone totally happy, but everyone feels is a good contract <br />and would like to implement it as soon as possible. <br /> <br /> Mr. Ed Lowry representing Virginia Television Company <br />addressed the Council and stated that throughout this period of <br />time Virginia Television Company has been interested in obtaining <br />the right to do business in th~ City of Charlottesville. He stated <br />that they are anxious for Virginia Television Company and others <br />if they so choose to have an opportunity to do business on a <br />free enterprise basis. Rs stated that Virginia Television Company <br />has filed an action in Court asking that Virginia Television <br />Company be given the right to bid competitively for any franchise <br />offered by the City. <br /> <br /> An ordinance entitled "AN ORDINANCE GRANTING A FRANCHISE TO <br /> MULTI-CHANNEL TV CABLE COMPANY OF MANSFIELD~ ITS SUCCESSORS OR <br /> ASSIGNS, TO O~WN AND OPERATE AND MANTAIN A CABLE CORPORATION SYSTEM <br /> IN CHARLOTTESVILLE, VIRGINIA, SETTING FORTH CONDITIONS ACCOMPYING <br /> THE GRANT OF FRANCHISE~ AND PROVIDING FOR THE REGULATION AND USE <br /> OF SAID SYSTEM," which was offered at the meeting of the Council on <br /> January 22, 1980, was adopted by the following recorded vote. Ayes: <br /> Mr. Albro, Mr~ Brunton, Mr~ Buck, Mr. Gatewood and Mrs. O'Brien. <br /> Noes: None. <br /> <br /> Mr. Albro stated that there was a question raised in the <br /> discussion of the ordinance relating to cable communications and <br /> CATV Systems at the last meeting regarding the question of the <br /> liability on the part of the franchisee for deformation or invasion <br /> of privacy or obsenity and after some research he has come to the <br /> conclusion that the City has no power to grant the franchisee <br /> immunity for liability. He stated that is a legislative matter for <br /> the General Assembly. He suggested the Subsection (c) under <br /> Section 5.1-9 be removed. <br /> <br /> On motion by Mr. Albro, seconded by Mrs. O'Brien the ordinance <br /> was amended to delete Subsection (c) under Section 5.1-9 entitled, <br /> "CENSORSHIp PROHIBITED," was unanimously adopted. <br /> <br /> An ordinance entitled "AN ORDINANCE TO AMEND THE CODE OF THE <br /> CITY OF CHARLOTTESVILLE, 1976, BY ADDING A CHAPTER NUMBERED 5.1, <br /> CONTAINING SECTIONS NUMBERED 5.1-1 THROUGH 5.1~9, RELATING TO <br /> CABLE COMPIUNICATIONS AND CATV SYSTEMS," which was offered at the <br /> meeting of the Council on January 22, 1980, was adopted as amended <br /> by the following recorded vote. Ayes: Mr. Albro, Mr. Brunton, <br /> Mr. Buck, Mr. Gatewood and Mrs. O'Brien. Noes: None. <br /> <br /> Mr. Sandy Lambert, Chairman of the McIntire Road Design <br /> Committee, briefly reported on the committee's activities to date <br /> and requested an extension of two weeks to present a final report. <br /> <br /> <br />
