Ordinance re: <br />Closing Parks & <br />Cemeteries During <br />Certain Hours <br /> <br />Ordinance re: <br />Bank Franchise Tax <br /> <br /> should be linked to the health and safety of the occupants <br /> as well as to the maintenance of structural integrity; Mr. <br /> Wiley agreed to make this change in the wording. <br /> <br /> On motion by Mrs. O'Brien, seconded by Mr. Albro, the <br /> suggested amendment was approved and the ordinance offered <br /> for consideration at the next meeting. <br /> <br /> Mrs. 0'Brien stated that she approves these changes <br /> <br /> but had hoped that Council could have achieved more in <br /> <br /> improving the maintenance of buildings and inspections. <br /> <br /> She had hoped that Council could find a way to make managing <br /> and owning property of .this nature a more uncomfortable <br /> business .in Charlottesville and is disappointed that a <br /> rental permit system does not exist. However, she appreciates <br /> Mr. Wiley's and the various inspectors' efforts in this <br /> direction. <br /> <br /> Mr. Hendrix presented an ordinance to close parks and <br /> cemeteries between midnight and 6:00 a.m. The Police Department <br /> wants more control in this matter and the effort is endorsed <br /> by the Parks.~& Recreation Department. Mr._Albro inquired why <br /> present laws are not sufficient to control whan happens during <br /> these hours. Mrs. O'Brien inquired how this ordinance would <br /> be used and if it was a useable ordinance. Mr. Hendrix stated <br /> that it would give the police the ability to discourage vandalism, <br /> late parties and other disturbances. Mr. Eugene German, Director <br /> of Parks & Recreation, pointed out that curfew violations can <br /> get people out before damage is done, whereas present enforcement <br /> can only take place once a disturbance or vandalism occurs. Mr. <br /> Wiley offered the opinion that signs should be posted eventually <br /> to inform people of closing~hours. Mr. Albro questioned the <br /> cost._of closing all parks and cemeteries and pointed out that <br /> some serve as neighborhood shortcuts and thoroughfares; he <br /> would not like to prohibit this type of peaceful use of an area. <br /> It was suggested that Jackson and Lee Parks could be omitted <br /> from the list and Mr. German had no objection to this. With <br /> this amendment, the ordinance entitled "AN ORDINANCE TO AMEND <br /> <br /> AND REORDAIN CHAPTER 18 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br /> 1976, AS AMENDED, BY ADDING SECTION 18-3 RELATING TO THE CLOSING <br /> OF PARKS AND CEMETERIES DURING CERTAIN HOURS" was offered and <br /> carried over to the next meeting for consideration on motion <br /> by Mrs. O'Brien, seconded by Mr. Gatewood. <br /> <br /> Mr. Roger Wiley, City Attorney, presented an ordinance <br /> <br />to permit the City to levy a bank francise tax. He said <br />that previously the City was permitted by State law to <br />collect a percentage of the State tax on bank stocks. The <br />Supreme Court of Montana recently ruled that tax on bank <br />stock that did not exclude portions of bank assets tied up in <br />Federal securities violated the supremacy clause of the <br />Federal Constitution. Virginia banks have now filed suits <br /> <br />245 <br /> <br /> <br />
