272 <br /> <br />Ordinance re: <br />Amending Chapter <br />25 relating to <br />sidewalk cafes <br /> <br />Other business <br /> <br />Executive session <br /> <br />Attorney with satisfactory evidence of such coverage-. <br /> <br />This permit may be revoked by City Council at any <br />time after a hearing conducted at any. regular meeting, <br />provided the~pperators have been notified of the <br />hearing by written notice.delivered to their place <br />of business at least five days before such meeting, <br />if the Council finds that the operators are violating <br />the terms of the permit or that the continued operation <br />of the cafe poses a threat to the public health, safety <br />and welfare or constitutes a public nuisance. <br /> <br /> On motion by Mrs~ 0'Brien, seconded by Mr. Albro, the <br />ordinance entitled "AN ORDINANCE TO AMEND CHAPTER 25 OF THE <br /> <br /> CODE <br /> <br />OF THE CITY OF CHARLOTTESVILLE, 1976, BY ADDING SECTION 25-28.1 <br />RELATING TO SIDEWALK CAFES" was offered and carried over to the <br />next meeting, for consideration, <br /> <br /> Mr. Albro stated that he has received a citizen inquiry <br />regarding the sewer charges for filling swimming pools and <br />wonders if there is some way that a pers~on who pays for water <br />to, fill a pool can be exempted from the sewer charges if <br />the water does not enter the s~ewer when the pool is emptied. <br />-He requested an ordinance to amend Section 24-2(c) to make <br />this change. Mrs. O'Brien suggested that the entire system <br />of metering and levying sewer charges be examined to~.~enable <br />her to respond to those citizens that complain about sewer <br />charges for the water they use in watering their lawns and <br />gardens.. She feels this would be a more equitable way of <br />dealing with the problem if the swimming pool complaints are <br />to be responded to at all. Mr. Hendrix noted that the staff <br />has done considerable study of the water and sewer rate system <br />and that to examine this particular facet of it would entail <br />much more work and time than might .be reasonable in relating to <br />the amount of credits that may result. He also stated that <br />to do this work would take some time and would not benefit <br />pool owners this summer unless .the action were made retroactive. <br />Mr. Wiley noted that there is a provision to exempt sewer <br />charges whsre applicable if the user installs a separate <br />meter, as some industrial users have done. Council agreed <br />that this matter would be dropped since a present solution is <br />available. <br /> Mr.~-Buck requested that the staff prepare some information <br /> regarding regulations concerning land use by state agencies, as <br /> Mr. Michie or Mr. Murray are willing to sponsor State legislation <br /> on this topic if they are prepared with appropriate information. <br /> Mr. Wiley agreed to talk to Mr, Michie and produce some material <br /> on the subject. <br /> Mayor Brunton thanked City employees and Council members <br /> who participated in the recent McDonals fundraiser for local <br /> institutions that result'ed in a donation of over $3,000 to <br /> six community agencies. <br /> On motion by Mrs. O'Brien, seconded by Mr. Buck, Council <br /> unanimously agreed to meet in executive session to discuss <br /> matters exempted under Section 2.1-344(a)(1)(Personnel) <br /> 2.1-344(a)(2)(PropertY)-and 2.1-344(a)(6)(Legal) of the <br /> <br /> <br />
