Resolution re <br />Granting special <br />permit extension <br />for Queen Charlotte <br />Square project <br /> <br />Work session re: <br />Utility rates <br /> <br />29Z <br /> <br />Council considered the following resolution: <br /> <br /> WHEREAS, on January 16, 1979, this Council granted to C.F. <br /> COrporation a special permit for development of the property comprising <br /> the block bounded by Jefferson, Third, High and Second Streets, NE; <br /> and <br /> <br /> WHEREAS, sin~e June 6, 1979, the development of such property <br /> has been delayed ~y the pendency of litigation challenging the <br /> validity of such ~pecial permit and the City ordinances under <br /> which it was granted; and <br /> <br /> WHEREAS such special pez~mit was held valid by a final order of <br /> the Circuit Court of the City of Charlottesville entered April 23, <br /> 1980, which is c~rently being appealed to the Supreme Court of <br /> Virginia; and <br /> <br /> WHEREAS thi,~ Council finds that due process of law and <br /> fundamental fairn,~ss to the parties involved in this litigation <br /> dictate that the ~tatus quo should be preserved until the legal <br /> issues presented :herein have been finally resolved; now, therefore <br /> be it ' <br /> <br /> RESOLVED by :he Council of the City of Charlottesville, <br /> Virginia, that th time limitation imposed by City Code Section <br /> 31-225. upon the s ~ecial permit granted to C.F. Corporation on <br /> January 16, 1979, is hereby extended to a date 12 months and 21 <br /> days after the dal:e of a final, non-appealable order entered <br /> by a court of coml~etent jurisdiction to dispose of any pending <br /> litigation challe~Lging the validity of such permit or the <br /> ordinances under ~ich it was granted. <br /> <br /> Mr, Conover, whil recognizing the fairness of extending the <br /> permit, wondered hether opponents of the project should be given <br /> the opportunity t comment on the extension, Mr. Albro stated <br /> he didn't think i! proper~or useful to re-open a discussion on <br /> the merits of the project, although he did not object to Mr. <br /> Conover's idea if the discussion were limited to the appropriateness <br /> of the procedure cf extending the special permit. Ms. Gleason <br /> <br /> oblem with bringing the matter totem Council <br /> <br /> favored Mr. Conover's idea of putting the <br /> <br /> ~genda for the next Council meeting to enable <br /> <br /> ~ublic to be heard by Council.~-~ On motion by <br /> <br /> by Dr. Hall, Council unanimously agreed to <br /> <br />n through July 23 and to place the item on the <br />y 21 Council meeting. <br />erich, Director of Public Works; Mr. Robert <br />f Finance, Mr. Tom Hayden, Assistant Director of <br />Sarrett, Assistant City Attorney; and Mr. <br />~ck & Beatch met with Council to discuss the <br />need for raising utility rates. A report was presented and <br />discussed concerning the need for higher gas and water rates and <br />changes, in deposit~,! miscellaneous fees and billing procedures. <br />By common consents, Council agreed to hold a public hearing on <br /> <br />the matter at ~he Iuly 21 meeting. <br /> On motion!the meeting adjourned.~ <br /> <br />said she had no pz <br />meeting.
