Resolution re Granting special permit extension for Queen Charlotte Square project Work session re: Utility rates 29Z Council considered the following resolution: WHEREAS, on January 16, 1979, this Council granted to C.F. COrporation a special permit for development of the property comprising the block bounded by Jefferson, Third, High and Second Streets, NE; and WHEREAS, sin~e June 6, 1979, the development of such property has been delayed ~y the pendency of litigation challenging the validity of such ~pecial permit and the City ordinances under which it was granted; and WHEREAS such special pez~mit was held valid by a final order of the Circuit Court of the City of Charlottesville entered April 23, 1980, which is c~rently being appealed to the Supreme Court of Virginia; and WHEREAS thi,~ Council finds that due process of law and fundamental fairn,~ss to the parties involved in this litigation dictate that the ~tatus quo should be preserved until the legal issues presented :herein have been finally resolved; now, therefore be it ' RESOLVED by :he Council of the City of Charlottesville, Virginia, that th time limitation imposed by City Code Section 31-225. upon the s ~ecial permit granted to C.F. Corporation on January 16, 1979, is hereby extended to a date 12 months and 21 days after the dal:e of a final, non-appealable order entered by a court of coml~etent jurisdiction to dispose of any pending litigation challe~Lging the validity of such permit or the ordinances under ~ich it was granted. Mr, Conover, whil recognizing the fairness of extending the permit, wondered hether opponents of the project should be given the opportunity t comment on the extension, Mr. Albro stated he didn't think i! proper~or useful to re-open a discussion on the merits of the project, although he did not object to Mr. Conover's idea if the discussion were limited to the appropriateness of the procedure cf extending the special permit. A report was presented and discussed concerning the need for higher gas and water rates and changes, in deposit~,! miscellaneous fees and billing procedures.
