328 <br /> <br />Resolution ~e.:~.~.~ <br />Authorizing mayor <br />to sign letter of <br />agreement with <br />Boothe, Prichard & <br />Pudley <br /> <br />Other business re.: <br />public hearing set <br />on taxi fares <br /> <br />Resolution re: <br />Authorizing condemna- <br />tion proceedings to <br />acquire easement <br />across parcel 100 <br />on Tax Map 29 <br /> <br />Executive session <br /> <br />Executive session <br /> <br /> In other business, Mr. Hendrix requested that COuncil authorize <br />thee mayor to sign a letter of agreement with B0othe, Prichard & <br />Dudley, the law fi.inn that will advise the City in its revenue sharing <br />negotiations~with the County of Albemarle. On motion by_ Mr. Albro, <br />seconded by Dr. Hall, the following resolution was unanimously <br /> <br />adopted: <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville <br />that tke Mayor is hereby authorized to execute on behalf of the City <br />the following document, in form approved by the City Attorney: <br /> Letter of agreement with Boothe, Prichard & Dudley for <br /> professional serVices. <br /> A copy of such document shall be kept on file with the minutes <br />of the Council meeting at which this resolution was adopted. <br /> Mayor Buck announced that a public hearing would be held at <br /> <br /> the next regular CoUncil meeting on October 6 to consider a rate <br /> increase or deregulation of the taxi fares in the City. <br /> ~ Mr. Roger WileY,-~ity Attorney, requested that Council authorize <br /> cOndemnation proceedings so that the City may acquire an easement <br /> across a piece of propertyneeded to complete the storm drainage <br /> proj~ect in Fifeville. On motion by Mr. Albro, seconded by Mr. <br /> Conover, Council unanimously adopted the following resolution: <br /> WHEREAS the City of Charlottesville, Virginia, needs to obtain <br /> a permanent easement and right-of-way to construct, replace, maintain <br /> and repair a, storm water drainage line for the conveyance of surface <br /> waters and drainage f~om property at higher elevations across a <br /> portion of a lot identified as Parcel 100 on City Real Property <br /> Tax Map 29, located within the City limits~and designated as 310 <br /> 6th Street, SW; and <br /> <br /> WHEREAS the easement and right,of-way are for a width of 10 <br /> feet on either side of the center line of the proposed storm water <br /> drainage line; and <br /> <br /> WHEREAS consent to the purchase of the property necessary for <br /> the project cannot be obtained because one or more of the owners is <br /> unable to convey legal title to such property; now, therefore, be it <br /> <br /> RESOLVED by the Council of the City of Charlottesville, Virginia, <br /> that a public necessity is .hereby declared to exist for the acquisition <br /> of a permanent easement and right-of-way across Parcel 100 on City <br /> Real Property Tax Map 29 in order to proceed with a storm water <br /> drainage improvement project; and be it <br /> <br /> FURTHER RESOLVED by the Council of the City of CharlottesVille, <br /> Virginia, that the City Attorney be and hereby is directed to <br /> institute condemnation,proceedings for the acquisition of the <br /> permanent easement and right,of.way across a portion of Parcel 100 <br /> on City Real Prop~rty'Tax Map 29 and to file the necessary document <br /> w~th the Circuit Court of the City of Charlottesville as provided in <br /> Sections 15.1-898 and 15.1-899 of the Code of ~i~ginia (195D), as <br /> amended, and Sections 41 and 50.1 of the Chartem~: of th.~ City of <br /> Charlottesville, Virginia. <br /> <br /> On motion by Ms. Gleason., seconded by Mr. Albro, Council <br /> unanimously agreed to meet"in executive session on Tuesday, Sgptember <br /> 16 at 7:00 p.m. to discuss matters exempted by Section 2.1-344(a) <br /> (6)(Legal) of the Virginia Freedom of Information Act. <br /> <br /> On motion by Mr. Convoer, seconded by Ms. Gleason, Council <br /> <br />unanimously agreed to meet 'in executive session following the close <br />of the re§ular meeting to discuss matters exempted by Section <br />2.1-344(a)(2)(Property) and (a)(6)(Legal) of the Virginia Freedom <br /> <br />of Information Act'. <br /> On motion the meeting adjourned. <br /> <br /> Clerk -- Pre~-u~ ~ <br /> <br /> <br />
