Appointment re: <br />Charlottesville <br />Development Group <br /> <br /> ordinance recently passed by the City of Fredericksburg that is <br /> similar to the one being considered by Council but levies a $500 <br /> per day business fee on itinerant dealers, making their activity <br /> unprofitable without penalizing permanent dealers. He stated that <br /> as long aa itinerant dealers were able to~ operate profitably within <br /> the City, th~. crime problem, would continue and enforcement of the <br /> ord%nance would be difficult ab best. <br /> <br /> Mr. Roger W~iley', City. Attorney, in responding to some of Mr. <br />Barnett~s concerns, stated that in his opinion a higher fee levied <br />againatitinerant.dealers .could be construed as discriminatory and <br />open th~ City to anti-trust liabilit% action. He conceded that the <br />elderly might have a problem with picture identification but false <br />identification is too easy to obtain'and the picture makes positive <br />identificati°n much more sure. On the matter of the six month <br />renewal of the license, he felt that the application was not <br />burdensome and thefrequentrenewal requirement would make enforcement <br />an easier task for the police department. <br /> <br /> Mr. Sandy Lambert brought to Council's attention all the <br /> <br />advertising in local papers by itinerant dealers. In his opinion, <br />the frequency and quality~of the ads indicates some kind of dishonest <br />anBi~i~yrmhst he-going on~.-illegal in the form of buying stolen goods <br />and immoral in the form of Cheating customers, especially the elderly. <br /> <br /> Mr. Barnett stated his concern again that the license fee is <br /> <br />not adequate. He pays over'S1,000 each year in business license <br />fees and these itinerant-~dealers can operate in the City for only <br />$'75 under th~ new. ordinance. He stated that the Attorney General <br />of Virginia recommended thewS500 per day fee that Fredericksburg adopted <br />and said again that if the itinerant dealers are not stopped, the <br />ordinance will essentially be a waste of time in its attempt to <br />stop illegal buying and selling of preciOus metals. <br /> <br /> Mr. Wiley stated tha't the $500 fee was Fredericksburg's idea; <br />theAttorney General only gave an opinion that a locality Could <br /> <br />levy such a fee, Mr. Wll~ <br />fee could place the City <br />~tated that th~ 'license <br />law t'o achieve conai~tenc <br />Mr. Albro agreed with Mr. <br />concern whenever a localit <br /> <br /> Mr. ~uck proposed th~ <br /> <br />~ re'i~erated his concern that a discriminatory <br />~ a legally VUlnerable position.
