3'46 Resolution re: Ivy Creek Natural ARea Ordinance re: Amending Section 16-63,5 of Code relating to bicycles (2nd reading) Ordinance re Closing portion of Albemarle Street (2nd reading) Matters by the public re: Complaint regarding Apple Classic Bicycle ~ Race On motion by Ms. Gleason, seconded by Mr. Conover, Council unanimously adopted the following resolution, with Mr~ Albro abstaining due to a conflict of interest:' WHEREAS the Virginia Commission of Outdoor Recreation provides funds to assist political subdivisions of the Commonwealth of Virginia ink,acquiring and developing open space and park lands; and WHEREAS there is an urgent need within the Charlottesville--.~ Albemarlecommunity to preserve open space lands for present and future recreational use; and WHEREAS The property adjoining the proposed expansion of the Ivy Creek Natural Area, containing approximately 16.5 acres, is deemed to be of high priority for acquisition and preservation as open space land; and WHEREAS in order to attain funding assistance for this project, it is required that eqch political subdivision provide a proportionate share of the cost thereof; and WHEREAS the proposed p{o~ect would be funded in the ratio of fifty percent from the Virginia Commission of Outdoor Recreation, 914 percent from the County of Albemarle and 9.4 percent from the City of Charlottesville with 31.2 percent as a gift of the owner, now, therefore, be it 20INTLY RESOLVED by the Board of Supervisors of the County of Albemarle and the Council of the City of Charlottesville that the County Executive and City Manager are hereby authorized and directed to furnish such information and materials as may be necessary to make application to the appropriate State and Federal agencies for funding of the acquisition of the aforesaid property; and BE IT FURTHER RESOLVED that the Board of Supervisors and City Council give their assurances that the funds required as the respective proportionate shares~of the County and City in the funding of such projects will be provided, up to a maximum of $8,000 from each jurisdiction; and BE IT FURTHER RESOLVED that the County of Albemarle and City of Charlottesville will abide by all applicable State and Federal regulations governing the expenditure of such funds to be provided by the Virginia Commission of Outdoor Recreation; and BE IT FURTHER RESOLVED that~the Heritage Conservation and Recreation Service of the United States Department of the Interior and the Virginia Commission of Outdoor Recreation are respectfully requested to assist in the prompt approval and funding of the acquisition for the expansion of the Ivy Creek Natural Area, in order to provide the benefits of increased permanent open space in the vicinity of the Rivanna Reservoir for the benefit of the citizens of the County of Albemarle and the City of Charlottesville. The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN SECTION 16=63.5 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, L976, AS AMENDED, RELATING TO BICYCLES" which was offered at the meeting of October 6 was adopted by the following vote. Ayes: Mr. Albro, Mr. Buck, Mr. Conover, Ms. Gleason, Dr. Hall. Noes: None. The ordinance entitled 'TAN ORDINANCE CLOSING, VACATING AND UISCON~INUING A PORTION OF ALBEMARLE STREET" which was offered at the meeting of October 6 w~as adopted by the following vote. Ayes: Mr. Albro, Mr. Buck, Mr, Conover, Ms. Gleason, Dr. Hall. Noes: None. Mr. Charlle Moore, a resident of the east downtown area, complained that the "no parking" signs placed in the area prior to the race prevented the usual use of the parking placea by churchgoers and significmntly decreased church attendance on that morning. He asked that nextYyear the signs plainly read that parking is not permitted after 12:30 p.m. Mayor Buck suggested that an evaluation of the race should be made now, ~ather than waiting till after next year's race and being confronted by complaints at that time.
