3'46 <br /> <br />Resolution re: <br />Ivy Creek Natural <br />ARea <br /> <br />Ordinance re: <br />Amending Section <br />16-63,5 of Code <br />relating to bicycles <br />(2nd reading) <br /> <br />Ordinance re <br />Closing portion of <br />Albemarle Street <br />(2nd reading) <br /> <br />Matters by the <br />public re: Complaint <br />regarding Apple <br />Classic Bicycle ~ <br />Race <br /> <br /> On motion by Ms. Gleason, seconded by Mr. Conover, Council <br />unanimously adopted the following resolution, with Mr~ Albro <br />abstaining due to a conflict of interest:' <br /> WHEREAS the Virginia Commission of Outdoor Recreation provides <br />funds to assist political subdivisions of the Commonwealth of Virginia <br />ink,acquiring and developing open space and park lands; and <br /> WHEREAS there is an urgent need within the Charlottesville--.~ <br />Albemarlecommunity to preserve open space lands for present and future <br />recreational use; and <br /> <br /> WHEREAS The property adjoining the proposed expansion of the <br /> Ivy Creek Natural Area, containing approximately 16.5 acres, is <br /> deemed to be of high priority for acquisition and preservation as <br /> open space land; and <br /> WHEREAS in order to attain funding assistance for this project, <br /> it is required that eqch political subdivision provide a proportionate <br /> share of the cost thereof; and <br /> WHEREAS the proposed p{o~ect would be funded in the ratio of <br /> fifty percent from the Virginia Commission of Outdoor Recreation, <br /> 914 percent from the County of Albemarle and 9.4 percent from the City <br /> of Charlottesville with 31.2 percent as a gift of the owner, now, <br /> therefore, be it <br /> <br /> 20INTLY RESOLVED by the Board of Supervisors of the County <br /> of Albemarle and the Council of the City of Charlottesville that the <br /> County Executive and City Manager are hereby authorized and directed <br /> to furnish such information and materials as may be necessary to <br /> make application to the appropriate State and Federal agencies for <br /> funding of the acquisition of the aforesaid property; and <br /> BE IT FURTHER RESOLVED that the Board of Supervisors and City <br /> Council give their assurances that the funds required as the <br /> respective proportionate shares~of the County and City in the funding <br /> of such projects will be provided, up to a maximum of $8,000 from <br /> each jurisdiction; and <br /> <br /> BE IT FURTHER RESOLVED that the County of Albemarle and City <br /> of Charlottesville will abide by all applicable State and Federal <br /> regulations governing the expenditure of such funds to be provided <br /> by the Virginia Commission of Outdoor Recreation; and <br /> BE IT FURTHER RESOLVED that~the Heritage Conservation and <br /> Recreation Service of the United States Department of the Interior and <br /> the Virginia Commission of Outdoor Recreation are respectfully <br /> requested to assist in the prompt approval and funding of the <br /> acquisition for the expansion of the Ivy Creek Natural Area, in order <br /> to provide the benefits of increased permanent open space in the <br /> vicinity of the Rivanna Reservoir for the benefit of the citizens <br /> of the County of Albemarle and the City of Charlottesville. <br /> <br /> The ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> SECTION 16=63.5 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, L976, <br /> AS AMENDED, RELATING TO BICYCLES" which was offered at the meeting of <br /> October 6 was adopted by the following vote. Ayes: Mr. Albro, Mr. <br /> <br />Buck, Mr. Conover, Ms. Gleason, Dr. Hall. Noes: None. <br /> <br /> The ordinance entitled 'TAN ORDINANCE CLOSING, VACATING AND <br /> <br />UISCON~INUING A PORTION OF ALBEMARLE STREET" which was offered at <br /> <br />the meeting of October 6 w~as adopted by the following vote. Ayes: <br />Mr. Albro, Mr. Buck, Mr, Conover, Ms. Gleason, Dr. Hall. Noes: <br /> <br />None. <br /> <br /> Mr. Charlle Moore, a resident of the east downtown area, <br />complained that the "no parking" signs placed in the area prior <br />to the race prevented the usual use of the parking placea by <br />churchgoers and significmntly decreased church attendance on that <br />morning. He asked that nextYyear the signs plainly read that <br />parking is not permitted after 12:30 p.m. Mayor Buck suggested <br />that an evaluation of the race should be made now, ~ather than <br />waiting till after next year's race and being confronted by complaints <br />at that time.
