<br />Resolution re:
<br />Granting special
<br />permit for 600
<br />Cherry Avenue
<br />
<br /> On motion by Mr. Albro, seconded by Mr. Conover, Council
<br />unanimously adopted the following resolution:
<br />
<br /> WHEREAS J.R.N. Chicken Stores, Inc., has applied for a
<br />special permit to use property owned by it located at 600 Cherry
<br />Avenue in a B-2 Business District as a restaurant with drive-in
<br />window; and
<br />
<br /> WHEREAS such application has been duly advertised as provided
<br />by law and has been the subject of a public hearing jointly held
<br />by this Council and the City Planning Commission on February 10,
<br />1981; and
<br />
<br /> WHEREAS the City Planning Commission has recommended approval
<br />of such special permit; now, therefore, be it
<br />
<br /> RESOLVED by the Council of the City Of Charlottesville,
<br />Virginia, that:
<br />
<br /> (1) that portion of City Real Property Tax Map Parcel
<br />29-233.3 presently located in a B-2 Business District, at 600
<br />Cherry Avenue, is hereby granted a special permit for use as
<br />a drive-in restaurann as permitted under Section 31-86 of the
<br />City Code.
<br />
<br /> (2) the Council finds that such use conforms to the
<br />requirements for special permits generally imposed by Article
<br />II (Section 31-218 et seq.) of Chapter 31 of the City Code and
<br />this permit is subject to all conditions and restrictions imposed
<br />generally by such article. ·
<br />
<br /> (3) such special permit shall be conditioned upon development
<br />of the property in accordance with the site plan, as conditioned
<br />by the Planning Commission and finally approved by the Director
<br />of Planning,
<br />
<br />Resolution re:

<br />tO sign agreement
<br />with VEPCO
<br />
<br /> (4) the applicant is requested to consider reducing the
<br />size of the presently non-conforming freestanding sign on the
<br />property by at least thirty per cent, as provided by Section
<br />31-170.1 of the City Code.
<br />
<br />On motion by Ms. Gleason, seconded by Mr. Albro, Council
<br />
<br />unanimously, adopted the following resolution:
<br />
<br /> BE IT RESOLVED by the Council of the City of Charlottesville,
<br />Virginia, that the Mayor is hereby authorized to execute on behalf
<br />of the City the following document, in form~proved by the City
<br />Attorney:

<br />on Sonoma St. & Bolling
<br />Ave.
<br />
<br />Agreement between the City of Charlottesville and VEPCO
<br />for the installation of underground facilities on City
<br />property near Grove Road and Meadowbrook Heights Road.
<br />
<br /> A copy of such document shall be kept on file with the
<br />minutes of the Council meeting at which this resolution was
<br />a~opted.

<br /> On motion by Mr. Conover, seconded by Dr. Hall, Council
<br />unanimously adopted the following resolution:
<br />
<br /> BE IT RESOLVED by the Council of the City of Charlottesville,
<br />Virginia, that the Mayor is hereby authorized to execute on
<br />behalf of the City the following document, in form~.approved by
<br />the City Attorney:
<br />
<br />A quitclaim deed to James E. and Nancy V. Shipp all the
<br />City's right, title and interest in and to a small parcel of
<br />land being part of the dedicated right-of-way of Sonoma
<br />Street and all the City's right, title and interest in and
<br />to a small parcel of land being part of the dedicated right-
<br />of-way of (old) Bolling Avenue.
<br />
<br /> A copy of such document shall be kept on file with the
<br />minutes of the Council meeting at which this resolution was
<br />adopted.
