Buck (signed) Clerk President COUNCIL CHAMBERS - MONDAY, i~AY 4,1981 Council met in regular session on this date with the following members present: Mr, Albro, Mr, Buck, Mr, Conover, Ms. Gleason, Dr. Hall. Absent: None. On motion by Ms. Gleason, seconded by Mr. Albro, Council unanimously agreed to meet in executive session to discuss matters exempted by Section 2,1-344(a).(1),(Personnel) of the Virginia Freedom of Information Act. Following the executive session, Council re=convened in regular session. On motion by Ms. Gleason, seconded by Mr. Albro, Council unanimously approved the minutes of April 20 as presented. On motion by Mr. Albro, seconded by Dr. Hall, Council unanimously approved the minutes of April 27 as presented. Council held a public hearing on the special permit application for the property at 2025 Ivy Road by Hardees. Ms. Ruth Batestin of 115 Bollingwood Road asked Council to do Something about the odor of charred meat and the litter problem that come from'Hardees, Though she bought her property knowing it was across the street from commercial properties, she 'still thought Hardees should be a responsible neighbor and try to alleviate these problems. Mr. James F, King, Jr., representing the Lewis Mountain Neighborhood.Association, also recommended that the smell and litter problems be controlled in some way, He said that the association endorses the application provided that Hardees abides by the conditions recommended by the Planning Commission. He also asked that the setback on Ivy Road not be reduced and questioned why the proposed addition to the building could not be added to the side rather than the front of the property. Mr. Ken Duke of Boddie-Noell Enterprises, Inc., operators of the Hardees in question, said that he would like to work with the neighbors and the home office to reduce the odor problem. He said they needed the extension on the front of the building for image and supervision reasons. Mr. Satyendra Huja, director of plannings, and community development, briefed Council on the special permit application and said that the Planning Commission recommended that Council grant the permit, He pointed out that the extension will reduce the litter problem by eliminating the outdoor seating.
