Buck (signed) <br /> Clerk President <br /> <br /> COUNCIL CHAMBERS - MONDAY, i~AY 4,1981 <br /> <br /> Council met in regular session on this date with the following <br />members present: Mr, Albro, Mr, Buck, Mr, Conover, Ms. Gleason, <br />Dr. Hall. Absent: None. <br /> <br /> On motion by Ms. Gleason, seconded by Mr. Albro, Council <br />unanimously agreed to meet in executive session to discuss <br />matters exempted by Section 2,1-344(a).(1),(Personnel) of the <br />Virginia Freedom of Information Act. Following the executive <br />session, Council re=convened in regular session. <br /> <br /> On motion by Ms. Gleason, seconded by Mr. Albro, Council <br />unanimously approved the minutes of April 20 as presented. <br /> <br />On motion by Mr. Albro, seconded by Dr. Hall, Council unanimously <br />approved the minutes of April 27 as presented. <br /> <br /> Council held a public hearing on the special permit application <br />for the property at 2025 Ivy Road by Hardees. <br /> <br /> Ms. Ruth Batestin of 115 Bollingwood Road asked Council <br /> <br />to do Something about the odor of charred meat and the litter <br />problem that come from'Hardees, Though she bought her property <br />knowing it was across the street from commercial properties, she <br />'still thought Hardees should be a responsible neighbor and try <br />to alleviate these problems. <br /> <br /> Mr. James F, King, Jr., representing the Lewis Mountain <br />Neighborhood.Association, also recommended that the smell and <br />litter problems be controlled in some way, He said that the <br />association endorses the application provided that Hardees <br />abides by the conditions recommended by the Planning Commission. <br />He also asked that the setback on Ivy Road not be reduced <br />and questioned why the proposed addition to the building <br />could not be added to the side rather than the front of the <br />property. <br /> <br /> Mr. Ken Duke of Boddie-Noell Enterprises, Inc., operators <br /> <br />of the Hardees in question, said that he would like to work <br />with the neighbors and the home office to reduce the odor problem. <br />He said they needed the extension on the front of the building <br />for image and supervision reasons. <br /> <br /> Mr. Satyendra Huja, director of plannings, and community <br />development, briefed Council on the special permit application <br />and said that the Planning Commission recommended that Council <br />grant the permit, He pointed out that the extension will reduce <br />the litter problem by eliminating the outdoor seating.
