Noes:'None.

The appropriati°n of $28,000'for. the repair of the roofs at
the City recreation centers, which was offered at the meeting of'
May 4, was adopted by the following vote. Ayes: Mr. Albro,
Mr. Buck, Mr. Conover, Ma. Gleason, Dr. Hall. NOes: None.
Council considered an appropriation of $220,147.14 as the
City's share of the cost of construction of the Ivy Landfill
road. Mr. COle Hendrix, City Manager, explained to Council that
the City had agreed to pay a share of the construction costs but
that the virginia'Department of HighWays' and Transportation had
not notified the City of the considerable cost overruns in
the construction until recently. Mr. Hendrix suggested that
Council authorize the staff to inform VDH&T that the City's

Share of these costs could not be paid until July 1, 1982. By

common consent, Council agreed to do so, as the mmount of

interest that can be earned on the funds during the next year

is considerable.

Council again considered the granti.ng of a special permit
for use of'the property located at 2025~Ivy Road which is a
Hardees facilitY. Mr. Hendrix, in response to Council's earlier
concern about neighbors' complaints of odor problems from the
restaurant, said that a letter had been received from Boddie-
Noell Enterprises, Inc,, the owner of the facility, stating
that they are installing new ventilating and filtering equipment
that will eliminate the odor problem. Mayor Buck asked if the
installation of this.~equipment could be made a special condition
of the permit, andMr. Wiley replied that i.t could. On motion
by Mr. Conover, seconded by Ms, Gleason, this amendment was
made and the resolution was adopted unanimously, as follows:

WHEREAS~Boddie-Noell Enterprises, Inc.~,.has applied for
a special pe~nit to use proeprty Owned by it and located at
2025 Ivy Road in a B-2 BusineSs District as a drive-in restaurant;
and
