44g <br /> <br />Resolution~re: <br />Granting special <br />permit for use of <br />property at John & <br />13th Streets <br /> <br /> 0n mdtion by Mr. Conover, seconded by Mr, Albro, <br /> <br />Council unanimously agreed to request that the Albemarle County <br />Board of SuperVisors pass an ordinance authorizing the charging <br />of fees for the disposal of tires at the landfill. Mr. Roger <br />Wiley, city attorney, agreed to handle the request. <br /> <br /> CoUncil again considered a resolution granting a special <br />permit for use of the property at gohn & t3th Streets as a group <br />home for mentally retarded adults. Fir. John Pezzoli,~of Region <br />Ten Community Services Board, the agency that is requesting that <br />the City sell the land for such a use, summarized the need for <br />such a home and the great effort that had been spent in planning <br />and publicizing the proposal. Mr. DOn Sandridge of the Charlottes- <br />ville-Albemarle Association forRetarded Citizens endorsed the <br />project on behalf of the CAARC board of directors. Ms. Dorothy <br />Emerson, a resident of the Venable neighborhood where the home <br />is p~oposed to. be located, also endorsed the project and said <br />that the retarded need that property more than the City school <br />system. <br /> <br /> On motion by M~. Gleason, seconded by Dr. Hall, Council <br />voted unanimously to sell the land at John and 13th Streets for <br />the use of a group home for mentally retarded adults. <br /> <br /> On.motion by Mr. Albro, seconded by Dr. Hall, Council <br />unanimously approved the following resolutiOn: <br /> <br /> WHEREAS William Meffert, managing partner of Residential <br />Alternatives Limited, has applied for a special permit to use <br />property, located at the northeast corner of John & 13th Streets, <br />N.~W., in an R-2 Residential District for construction of ~a <br />group home for not more than eight mentally retarded orhandi- <br />capped adults; and <br /> <br /> WHEREAS such application has been duly advertised, as <br />prov~e'd by'law'and has been the subjectof public hearings <br />before the City Planning Commission on April 14, 1981, and <br />before this Council on May 4, 1981; and <br /> <br /> WHEREAS the City Planning Commission has recommended <br />approval of such special permit; now, therefore, be it <br /> <br /> RESOLVED by the Council of the City of Charlottesville, <br />Virginia, that- <br /> <br />(1) City Real Property Tax Map Parcel 4-227.1, located at <br />the northeast corner of John & 13th Streets, N.W., is <br />hereby granted a special permit for use as a group home <br />for not,more than eight mentally retarded or handicapped <br />adults, as permitted by Sections 31-14 (f) and 31-21 of <br />the City Code. <br /> <br />(2) The Council finds that such use conforms to the require- <br />ments for special permits generally imposed by Article XX <br />(Section 31-218 et seq,) of Chapter 31 of the City Code and <br />this permit is subject to all conditions and restrictions <br />imposed generally by such article. <br /> <br />(3) Such special permit shall be conditioned upon <br />development of the property in accordance with the site <br />Plan, as conditioned by the Planning CommiSsion and finally <br />approved by the Director of Planning. <br /> <br />Mayor Buck commened the school board~on its handling of <br /> <br />a difficult decision to oppose the use of the property in <br /> <br />question in favor of the school system's possible future use. <br /> <br />He reminded everyone that the members of the school board, though <br />perhaps in personal sympathy with the Region Ten proposal, had <br />a responsibility to look out for the welfare of the school system. <br />Mr. Conover complimented Region Ten on its effective representation <br /> <br /> <br />
