Regular meeting <br /> <br />Approval of <br />minutes <br /> <br />Public Hearing re: <br />Downtown Mall <br />Special Assess- <br />ment Ordinance <br /> <br /> 145 <br />COUNCIL CHAMBER - MONDAY, AUGUST 16, 1978 <br /> <br /> The Council met in regular session on this date with the following <br /> members present: Mr. Barbour, Mr. Brunton, Mr. Fife and Mr. Gatewood. <br /> Absent: Mrs. O'Brien. <br /> <br /> The minutes of the meeting of August 2, 1976 were approved as <br /> corrected. <br /> <br /> A public hearing was held on a proposed ordinance creating a <br />special assessment district in the Downtown Mall Area. Mr. Fife <br />announced due to a possible conflict of interest he would not be <br />participating in any of the discussion or voting on this matter. <br /> <br />The City Attorney announced that the ordinanee has been published as <br />required by law and explained the proposed ordinance. Mr. Tom <br />Branham, City Assessor addressed the Council and explained the <br />method used in determining the amount of assessment for the <br />properties effected by the Mall construction. The following letter <br />was presented from National Bank and Trust Company: <br /> <br />Mrs. Mayor and Members of City Council <br />City Hall <br />Charlottesville, Virginia 22901 <br /> <br />Dear Mrs. Mayor and Members of .City Council: <br /> <br />We represent, in various capacities, the owners of the property known <br />as 215 East Main Street, the forward part of which is presently <br />rented to Trolls of Norway. <br /> <br />We believe that the sPecial tax assessment of this property, which <br />comprises four (4) separate tracts of land, is inappropriate, <br />inequitable and unfair, and that the special tax assessment should <br />be reduced to ~ake into account this separation. <br /> <br />An official request has been made to City Attorney, Roger Wiley, and <br />to City Assessor, Thomas Branham, to consider the three (3) tracts <br />of land on Third Street as a single tax parcel and, also as a single <br />tax parcel, the one (1) tract fronting on Main Street and running <br />back to Market Street. <br /> <br />In our opinion only the parcel fronting on Main Street should be <br />included in the special tax assesgment. The value of the three tracts <br />on the corner of Third Street and Market Street should be excluded <br />from the special tax assessment. <br /> <br />We request that this protest be made a part of the official record of <br />the August 16, 1976, public hearing. <br /> <br />Very truly yours, <br /> <br /> John Fischbeck (signed) <br /> John Fischbeck <br /> Trust Officer <br /> <br />Mr. Mike Termain, addressed the Council and stated that it was his <br />understanding when preliminary plans were being developed for the <br />Mall that a total of 157 properties would be effected and assessed <br />for a portion of the cost. He stated that only 55 properties were <br />effected by the completed Mall, but were still being asked to pay the <br />same total amount of the cost.
