170 <br /> <br /> A communication was also presented from the Planning <br />Ordinance re: Rezoning <br />from R-2 to B-2 Property Commission recommending that Lots 17 and 18 of Parcel 68 as <br />located on the south- <br />west corner of Avon ~-?~:~ shown on Sheet 59 of the City Real Property THx Map be rezoned <br />Street and Palatine <br />Avenue - DENIED from R-2 to B-2 and to deny the zoning change on Lots 8 and 9 <br /> <br /> of parcel 367 on tax map sheet 59A - Mr.~Huja, Director of <br /> Planning, presented the staff recommendations as follows: D~eny <br /> the application since it is against the 1990 Land Use Plan; it <br /> will have an adverse impact on the residential area especially <br /> the northern part of the property; B-2 zoning is primarily <br /> for neighborhood commercial and this property is not centrally <br /> located to serve that function; and this is a major entrance <br /> to the City and thus should be protected from traffic as well <br /> as visual hazards' He also stated that the staff could <br /> recommend the alternative of allowing the rezoning of the <br /> southern section Lots 17 and 18 of the application since <br /> existing B-2 zoned lots to the south are owned by the <br /> applicant and part of it falls in the flood plain, this <br /> additional rezoning of B-2 along with the existing B-2 could <br /> result in a usable piece of property for business, thus not <br /> creating hardships on the owner and will still protect the <br /> residential environment in the northern area. An ordinance <br /> entitled "AN ORDINANCE A~MENDING AND REENACTING THE DISTRICT <br /> MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE <br /> CODE OF THE CITY OF CHARLOTTESVILLE, 1976, BY THE REZONING <br /> OF A PARCEL OF LAND FRONTING ON AVON STREET IN THE CITY OF <br /> CHARLOTTESVILLE," was offered by Mr. Gatewood, seconded by Mr. <br /> Brunton and defeated by the following recorded vote. S. Department of <br />Transportation in accord with the provisions of Title VI of <br />the Civil Rights Act of 1964, that in connection with the <br />filing of an application for assistance under the Urban ~iass <br />Transportation Act of 1964, as amended, the applicant gives <br />an assurance that it will comply with Title VI of the Civil <br />Rights Act of 1964 and the U.
