170 A communication was also presented from the Planning Ordinance re: Rezoning from R-2 to B-2 Property Commission recommending that Lots 17 and 18 of Parcel 68 as located on the south- west corner of Avon ~-?~:~ shown on Sheet 59 of the City Real Property THx Map be rezoned Street and Palatine Avenue - DENIED from R-2 to B-2 and to deny the zoning change on Lots 8 and 9 of parcel 367 on tax map sheet 59A - Mr.~Huja, Director of Planning, presented the staff recommendations as follows: D~eny the application since it is against the 1990 Land Use Plan; it will have an adverse impact on the residential area especially the northern part of the property; B-2 zoning is primarily for neighborhood commercial and this property is not centrally located to serve that function; and this is a major entrance to the City and thus should be protected from traffic as well as visual hazards' He also stated that the staff could recommend the alternative of allowing the rezoning of the southern section Lots 17 and 18 of the application since existing B-2 zoned lots to the south are owned by the applicant and part of it falls in the flood plain, this additional rezoning of B-2 along with the existing B-2 could result in a usable piece of property for business, thus not creating hardships on the owner and will still protect the residential environment in the northern area. An ordinance entitled "AN ORDINANCE A~MENDING AND REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, BY THE REZONING OF A PARCEL OF LAND FRONTING ON AVON STREET IN THE CITY OF CHARLOTTESVILLE," was offered by Mr. Gatewood, seconded by Mr. Brunton and defeated by the following recorded vote. Ayes: Mr. Gatewood~ Noes: Mr. Brunton, Mr. Fife and Mrs. O'Brien. Appointment re: Manpower Planning Council Resolution re: UMTA Mr. Barbour, Abstained~ On motion by Mr. Fife, seconded by Mr. Brunton, Mr. J' d Hal Brindley, was appoznte an alternate member of the Manpower Planning Council, by unanimous vote. On motion by Mr. Brunton, seconded by Mr. Barbour the following resolution was unanimously adopted. WHEREAS, the Secretary of Transportation is authorized to make grants for mass transportation projects; WHEREAS,, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project cost; and WHEREAS, it is required by the U. S. Department of Transportation in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance under the Urban ~iass Transportation Act of 1964, as amended, the applicant gives an assurance that it will comply with Title VI of the Civil Rights Act of 1964 and the U. S. Department of Transportation requirements thereunder:
