310 <br /> <br />Consideration re: <br />Rezoning - Ivy <br />Road - Denied <br /> <br />Consideration re: <br />Ordinance - Rezoning <br />property at <br />Monticello Ave. & <br />Druid Ave. from <br />R-2 to B-3 <br /> <br />Consideration re: <br />Ordinance - Off- <br />Street Parking <br />Requirements <br /> <br />Consideration re: <br />Ordinance - Tax and <br />Rental Relief <br />Program for <br />elderly persons <br />Totally and <br />Permanently <br />Disabled <br /> <br />City's Join..~brief <br />to be filed regarding <br />permit parking <br /> <br />Executive Session <br /> <br /> A communication was presented from the Planning Commission <br />recommending that the petition to rezone property located at <br />2001 and 2019 Ivy Road be denied for the following reasons: 1. <br />It is conflict With 1990 Land Use Plan; 2. Potential uses in <br />a B-1 zone would be incompatible with the residential neighborhood; <br />3. Potential access through the Bollingwood Road side to one <br />of the lots could have an adverse effect on the neighborhood; and <br />4. 'It is the policy of the City to protect the integrity of a <br />residential neighborhood, which this rezoning would violate. On <br />motion by Mr. Fife.,,~econded by Mr. Barbour the recommendation <br />of the Planning Commission was unanimously adopted. <br /> A communication was also presented from the Planning Commission <br /> recommending that the petition to rezone property located at the <br /> southwest corner of Druid Avenue and Monticello Avenue from R-2 <br /> Residential to B-3 Business be approved. An ordinance entitled <br /> "AN ORDINANCE AMENDING AND REENACTING THE DISTRICT MAP INCORPORATED <br /> IN SECTION 31-4 OF THE ZONING ORDINANCE OF THE CODE OF THE CITY <br /> OF CHARLOTTESVILLE, 1976, BY THE REZONING OF SEVERAL PARCELS OF <br /> LAND FRONTING ON MONTICELLO AVENUE AND DRUID AVENUE AND ONE <br /> PARCEL FRONTING ON STONEHENGE AVENUE IN THE CITY OF CHARLOTTES- <br /> VILLE,'' was offered by Mr. Gatewood, seconded by Mr. Brunton and <br /> carried over to the next meeting for consideration. <br /> <br /> An ordinance entitled "AN ORDINANCE TO AMEND AND REORDAIN <br /> SECTION 31-151 OF THE CODE OF THE CITY OF CHARLOTTESVILLE, 1976, <br /> AS AMENDED, RELATING TO THE AREAS EXEMPTED FROM OFF-STREET <br /> PARKING REQUIREMENTS UNDER THE CITY ZONING ORDINANCE," was offered <br /> by Mr. Gatewood, seconded by Mr. Brunton and carried over to the <br /> next meeting for consideration. <br /> <br /> An ordinance entitled "AN ORDINANCE TO AMEND SECTION 10-36 <br /> THROUGH 10-39 AND 30-9 THROUGH 30-12 OF. THE CODE OF THE CITY <br /> OF CHARLOTTESVILLE, 1976, AS AMENDED, IN ORDER TO EXTEND THE <br /> TAX AND RENTAL RELIEF PROGRAMS 'FOR THE ELDERLY TO PERSONS <br /> WHO ARE TOTALLY AND PERMANENTLY DISABLED, AND FURTHER TO AMEND <br /> THE DEFINITION OF "DWELLING" APPLICABLE TO SUCH PROGRAM," was <br /> offered by Mr. Barbour, seconded by Mr. Gatewood and carried over <br /> to the next meeting for consideration. <br /> <br /> On recommendation of the City Attorney the Council authorized <br /> the City's joining in a brief to be filed by the City of <br /> Alexandria with the Virginia Supreme Court in the case of <br /> Arlington County vs. Richards involving the constitutionality <br /> of permit parking systems for residential areas. <br /> On motion by Mr. Brunton, seconded by Mr. Fife that Council <br /> meet in executive session to discuss matters exempted, by Section <br /> 2.1-344(a)(1), Section 2.1-344(a)(2) and Section 2.1-344(a)(6) of <br /> the Virginia Freedom of Information Act, was adopted by the following <br /> recorded vote. Ayes: Mr. Barbour, Mr. Brunton, Mr. Fife, Mr. <br /> Gatewood and Mrs. O'Brien. Noes: None. <br /> <br /> On motion the meeting adjourned. <br /> <br /> <br />
