Consideration re: <br />Rezoning property <br />lOcated at 883 <br />Locust Avenue - <br />Denied <br /> <br />Resolution re: <br />~RTA <br /> <br /> OF THE CITY OF CHARLQ~SV'ILLE, 1976 BY THE REZONING OF TWO <br /> PARCELS OF LAND FRONTING~0'N LOCUST AVENUE IN THE CITY OF <br /> CHARLOTTESVILLE," was offered by Mr. Fife, seconded by Mr. Brunton <br /> and carried over to the next meeting for consideration. <br /> <br /> A communication was also presented from the Planning Co~nission <br />recommending denial of the petition to rezone property located at <br />the rear of 883 Locust Avenue at the corner of 250 By-pass and <br />St. Charles Avenue for the following reasons: 1. this could <br />resolt in traffic conflict on the off-ramp of the 250 By-pass; 2. <br />this property has an excessive slope of 20% and could result in <br />the destruction of some natural vegetation if developed as two- <br />family dwellings for possible six units, compared to the two <br />single family units allowed under the present zoning; 3. the <br />property with its present zoning can be developed in a compatable <br />manner with the surrounding properties; 4'. any rezoning to R-2 <br />west of the present R-2 boundaries would be an intrusion into <br />a continuious R-1 zone delineation, thus setting a prescedent; <br />and 5. the property acrosls the 250 By-pass has similar R-l-R-2 <br />zoning split and has been developed in an economically <br />feasible manner and is harmonious with the s~rrounding environment. <br />A motion by Mr. Fife, seconded by Mr. Gatewood that the request <br />be denied, was unanimously adopted. <br /> <br /> On motion by Mr. Brunton, seconded by Mr. Fife the following <br />resolution was unanimously adopted. <br /> <br /> WHEREAS, the Secretary of Transportation is authorized <br /> to make grants for mass trAnspo~tatio~projects; <br /> <br /> WHEREAS, the contract for financial assistance will <br />impose certain obligations upon the applicant, including the <br />provision by it o£ the local share of project costs; and <br /> <br /> WHEREAS, it is r~quired by the U. S. Department of <br />~{a~port~tion in accord w~th the provisions of Title VI of the <br />~zvil Rights Act 9f 1964, ~hat in connection with the filing of <br />an application for aSsistance under the Urban Mass Trans ortation <br /> I . P <br />Act of 1964, as amended, the applzcant gives an assurance that <br />it will comply with Title VI of'the Civil Rights Act of 1964 <br />and the U. S. Department of Trans.portation~requirements there- <br />under: <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of CharlotteSville, V~rginia <br /> ~ (1)~ That! the Ci y Manager ms' authorized to execute <br /> an~ file an amended application on behalf of the <br /> City of Chazlottesville With the U. S. Department <br /> of Transportation, to aid in the financing of a <br /> bus transit system including the purchase of <br /> twelve small-to-medium size diesel buses equipped <br /> with two-way radios, construction of a maintenance <br /> <br /> q 'P existing private bus transit <br /> system. <br /> <br />(2) <br /> <br />(3) <br /> <br /> That the Cit~ Manager is authorized to execute and <br /> file with sugh application an assurance or any <br /> other document required by the U. S. Department of <br /> ~{anspor~ati~n effecuating the purpose of the <br />"'Tztle VI of ~he Civil Rights Act of 1964. <br /> <br />That Cole Hendrix, City Manager, is authorized to <br />furnish such additional information as the U.
