The northwest part of the site which is higher <br /> than the other parts of the site must not be significantly <br /> encroached upon and major trees on that a~ea must be protected. <br /> Mr. Barbour stated that he objected to the location of this <br /> project. On motion by Mr. Fife, seconded by Mr. Brunton the <br /> recommendation of the Planning Commission was unanimously <br /> adopted. On motion by Mr. Fife, seconded by Mr. Brunton the <br /> following resolution was unanimously adopted. <br /> <br /> BE IT RESOLVED by the council of the City of <br />Charlottesville that there is hereby granted pursuant to <br />§31-33 of the COde of the 'City of Charlottesville, 1976, as <br />amended, a special permit for the use of the property located <br />at'the southeast corner of Ridge Street and West Main Street, <br />designated on City Real Property Tax Map 28 as Parcel 93, for <br />construction of a highrise apartment building, intended for <br />occupancY by elderly residents, at a density of 42.5 units <br />per acre, or a maxzmum of 100 units on such property. Such <br />permit shall be subject to the conditions and regulations set <br />forth in the aforesaid §31-33 for such higher density develop- <br />menn, to all general conditions and regulations imposed upon <br />special permits by Chapter 31 of such City Code, including <br />the obtaining by the developers of an approved site plan prior <br />to initiating use of the property for s~ch put.poses, and to the <br />following special conditions: <br /> <br />393 <br /> <br /> (a) The building to be constructed on such site shall have <br />not more than nine stories above ground level. <br /> <br /> (b) The building concept and site orientation shown on the <br />preliminary plan presented with the application for this special <br />permit shall be maintained. <br /> <br /> (c) The northwest portion of the property shall be <br />substantially preserved in its present form and contours and <br />major trees on such protion of th~ site shall be protected. <br /> <br /> (d) The site shall be ~screened from the railrOad on the <br />east and south and from Ridge Street from the west through <br />fencing or adequately dense vegetation, provided.that the <br />screening along Ridge Street shall take the form of a fence <br />or retaining wall sufficient to discourage pedestrian move- <br />ment through the site. <br /> <br /> On motion by Mr. Fife, seconded by Mr. Barbour <br />f°llow~ng resolution was unanimously adopted. <br /> <br />the <br /> <br /> A RESOLUTION appointing viewers to consider a request <br />for the vacation of a portion of Moore Street. <br /> <br /> WHEREAS, this Council has received a petition requesting <br />vacation of a portion of Moore Street; and <br /> <br /> WHEREAS, it appears to Council that the notices <br />required by ~15.1-364 of the Code of Virginia (1950), as <br />amended, have been duly posted; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Charlottesville that Messrs. W. J. Copeland, Harry T. <br />Marshall and H. P. Winn report in writing to Council what <br />inconvenience, if any, would result from such vacation. <br /> <br /> <br />
