He feels the wood <br />porch in this area is an important architectural <br />characteristic. He stated that he felt the review board <br />has evidenced good faith in attempting to work with the <br />owner in an effort to find a way in which the work that <br />has been dOne need not be scraped and yet work can be <br />completed to make the building safe and attractive in <br />a manner that is consistant with the original design <br />co~ncepts. On motion by Mr. Albro, seconded by Mrs. <br />O'Brien the following resolution was unanimously adopted. <br /> WHEREAS, Mr. Robert M. Byrom has applied <br /> to the Board of Architectural Review for a certificate <br /> of appropriateness for certain modifications to the <br /> building located at 609 E. High Street which is within <br /> the boundaries of the Architectural Design Control <br /> District; and <br /> WHEREAS, the Board of Architectural Review has <br /> denied such certificate of appropriateness for a proposed <br /> brick veneer porch floor for such building; and <br /> WHEREAS,_~Mr. Byrom-~as appealed this decision <br /> to the City Councilas.provided by §3t-t47.I~of~the <br /> City Code; and <br /> WHEREAS., the Council has reviewed the minutes <br /> of the meetings at which this matter was considered by the <br /> Board of Architectural Review and written materials <br /> presented by and on behalf of Mr. Byrom and has heard <br /> arguments presented by Mr. Byrom and by representatives <br /> of the Board in open Council meeting, and after due <br /> deliberation has determined that the decision of the <br /> Board should be upheld, now therefore, be it <br /> <br /> RESOLVED by the Council of the City of <br /> CharlottesVille that the appeal of Robert M. Byrom <br /> from the aforesaid decision of the Board of <br /> Architectural Review is denied and such decision is <br /> hereby affirmed. <br /> <br /> An ordinance entitled "AN ORDINANCE CLOSING, <br /> <br /> VACATING AND DISCONTINUING A PORTION OF THE ABANDONED <br /> RIGHT-OF-WAY OF .OLD MELBOURNE ROAD IN THE CITY OF <br /> CHARLOTTESVILLE," which was offered at the meeting of the <br /> Council on October 16~ 1978, was adopted by the following <br /> recorded vote. Ayes: }~. Albro, Mr. Brunton, Mr. Buck,. <br /> Mr. Gatewood and Mrs. O'Brien. Noes: None. <br /> An ordinance entitled "AN ORDINANCE Ab~NDING AND <br /> REENACTING THE DISTRICT MAP INCORPORATED IN SECTION 31-4 <br /> OF THE ZONING ORDINANCE OF THE CODE OF THE CITY OF <br /> CHARLOTTESVILLE~ 1976, BY THE REZONING OF TWO PARCELS <br /> OF LAND LOCATED AT THE SOUTHWEST SECTION OF HARRIS <br /> ROAD AND 5TH STREET, S. W. iN THE CITY OF CHARLOTTESVILLE," <br /> was offered by Mr. Albro, seconded by Mr. Gatewood and <br /> carried over to the next meeting for consideration. <br /> An ordinance entitled "AN ORDINANCE TO Ai~END AND <br /> REORDAIN ~10-39 AND ~30-12-0F THE CODE OF THE CITY OF <br /> CHARLOTTESVILLE, 1976, AS AMENDED, RELATING TO THE DATES <br /> FOR FILING FOR EXEMPTION FROM REAL ESTATE TAX AND FOR <br /> RENTAL RELIEF FOR THE ELDERLY AND DISABLED," which was <br /> offered at the meeting of the Council on October 16, 1978 <br /> <br /> <br />
