I1 REFERRED T° <br />PLANNING COMMISSION <br /> <br /> WHEREAS, THE COUNCIL OF THE CITY OF CHARLOTTESVILLE IS WILLING TO <br /> <br />CLOSE AND VACATE THE ALLEY ACCORDING TO THE PLANNING COMMISSION'S RECOMMENDATION <br /> <br />AS HEREINAFTER DESCRIBED, <br /> <br /> NOW~ THEREFORE~ BE IT RESOLVED BY THE COUNCIL OF THE CiTY OF CHARLOTTES- <br />VILLE THAT AN UNOPENED AND UNNAMED ALLEY 15~ IN WIDTH, EXTENDING FROM MAYWOOD LANE <br />TO VALLEY ROAD AS SHOWN ON A PLAT OF O. Ro RANDOLPH~ DATED APRIL 4, 1968, WHICH IS <br />HERETO AT~ACHED AND INCORPORATED BY REFERENCE~ BE AND THE SAME IS HEREBY CLOSED <br /> <br />AND VACATED; AND PROVIDED FURTHER THAT THIS VACATION SHALL NOT EXTINGUISH EXISTING <br />UTILITY LINE EASEMENTS FOR TELEPHONE~ ELECTRIC AND T. Mo CABLE LINES t.N THE AREA <br />HEREIN CLOSED AND VACATED; AND PROVIDED FURTHER THAT THE CiTY RETAINS AND RESERVES <br />TO ITSELF THE RIGHT TO LAY, MAtNTAIN~ REPAIR AND OPERATE ITS UTILITY LINES WHICH <br />ARE NOW OR MAY BE INSTALLED IN SAID AREA HEREIN CLOSED AND VACATED. TITLE TO THE <br />ALLEY SUBdECT TO THE UTILITY EASEMENTS HEREIN RESERVED, CLOSED BY THIS RESOLUTION <br />SHALL REVERT ONE-HALF TO EACH ABUTTING PROPERTY OWNER. <br /> <br /> BE IT FURTHER RESOLVED THAT THE CLERK OF THE COUNCIL BE AND HE IS HEREBY <br />DIRECTED TO RECORD THIS RESOLUTION AND SKETCH IN THE CLERKtS OFFICE OF THE CORPORATION <br />COURT OF THE CITY OF CHARLOTTESVILLE. <br /> <br /> A COMMUNICATION WAS PRESENTED FROM THE PLANNING COMMISSION ADVISING THAT THE <br />PROPERTY OF ALBEMARLE DEVELOPMENT CORPORATION~ FOR WHICH UTILITIES HAVE BEEN RE- <br />QUESTED~ IS IN AN AREA LIKELY TO BE ANNEXED IN THE NEAR FUTURE. THE CITY MANAGER <br />RECOMMENDED THAT UTILITIES BE GRANTED UNDER THE USUAL TERMS AND CONDITIONS FOR <br />COUNTY CONNECTIONS. ON MOTION BY MR. VAN YAHRES, SECONDED BY MR. RINEHART, THE <br />FOREGOING RECOMMENDATION WAS APPROVED BY THE FOLLOWING VOTE: AYES: MR. RINEHART~ <br />MR. VAN YAHRES~ MR. VOGT. NOES: NONE. (MR. DAVIS NOT VOTING) <br /> <br /> A COMMUNICATION WAS PRESENTED FROM THE PLANNING COMMISSION RECOMMENDING THAT <br /> <br />THE REQUEST FOR REZONING ON NASSAU STREET TO M-1 INDUSTRIAL BE DENIED, BUT THAT <br />THE AREA BE REZONED TO B-3 BUSINESS. A PUBLIC HEARING WAS SET FOR JANUARY 6, 1969 <br />AT 7:30 P. M. TO CONSIDER THIS REQUEST. <br /> <br /> A COMMUNICATION WAS PRESENTED FROM THE PLANNING COMMISSION RECOMMENDING THAT <br /> <br />THE REQUEST FOR REZONING 1t3-119 MAURY AVENUE TO B-2 BUSINESS BE DENIED~ AND THAT <br />THE USE REGULATIONS BE AMENDED TO ALLOW BILLIARD PARLORS IN B-1 BUSINESS DISTRICTS. <br />ACTION WAS DEFERRED AND THE PETITION REFERRED BACK TO THE PLANNING COMMISSION FOR A <br />PUBLIC HEARING. <br /> <br /> A COMMUNICATION WAS PRESENTED FROM THE PLANNING COMMISSION RECOMMENDING THAT <br />SECTION 5~ PARAGRAPH 1 AND SECTION 6) PARAGRAPH 1 RELATING TO TIME REQUIRED FOR <br />SUBMISSION OF PLATS BE AMENDED. TH~S MATTER WAS REFERRED BACK TO THE PLANNING <br />COMMISSION FOR A PUBLIC HEARING. <br /> <br /> THE CItY MANAGER ADVISED THE COUNCIL THAT HE HAD RECEIVED A COPY OF A LETTER <br /> <br />FROM THE ENGINEERING Firm DOING THE WORK AT THE AiRPOrt SUGGESTING that IT WOULD BE <br />TO THE ADVANTAGE OF THE CITY AND COUNTY TO ALLOW THEM TO PREPARE PLANS FOR THE TAXI- <br />WAY AND WARMUP PAD AT THE SAME TIME PLANS ARE PREPARED FOR THE RAMP AND ESTIMATING <br />THE SAVINGS WOULD BE APPROXIMATELY ~4~600.00. MR. BOWEN RECOMMENDED THAT THE COUNTY <br />BE CONSULTED BEFORE TAKING ANY ACTION, AND SUGGESTED THAT A MEETING BE ARRANGED WITH <br />THE BOARD OF SUPERVISORS. AT THE SUGGESTION OF THE MAYOR, THIS MATTER WAS REFERRED <br />TO THE AIRPORT COMMISSION FOR RECOMHENDATION~ AND THEN ARRANGE A MEETING WITH THE <br />BOARD OF SUPERVISORS TO DISCUSS THE RECOMMENDATION OF THE COMMISSION. <br /> <br /> AN ORDINANCE AMENDING SECTION 76 OF APPENDIX II RELATED TO THE PROCEDURE FOR <br />AMENDING THE ZONING ORDINANCE WAS PRESENTED, AND ON MOTION BY MR. DAVIS~ SECONDED <br />BY MR. VAN YAHRES WAS REFERRED TO THE PLANNING COMMISSION FOR RECOMMENDATION. <br /> <br /> <br />
