BARBOUR~ MR. FIFE~ MR. GILLIAM~ MRS. RINEHART AND MR. VAN YAHRES. <br />ABSENT: NONE. <br /> <br /> REv. CARL BEARD~ ASSOCIATE MINISTER OF THE UNIVERSITY BAPTIST CHURCH <br /> <br />GAVE THE INVOCATION. <br /> <br /> THE MINUTES OF THE MEETING Of NOVEMBER 6~ 1972 WERE APPROVED AS CORRECTED. <br /> MR. RICHARD H. BARRICK~ ADDRESSED THE COUNCIL AND PRESENTED THE FOLLOWING <br />REPORT: <br /> <br /> THE COHMITTEE APPO;[NTED BY YOU TO STUDY IMPLEMENTATION OF THE DISTRICT <br />COURT PLAN FOR THE COURTS NOT OF RECORD SUBMITS HEREWITH AN INTERM REPORT AS <br />FOLLOWS: <br /> <br /> IN ITS LAST SESSION~ THE GENERAL ASSEMBLY PASSED LEGISLATION TO ESTABLISH <br /> A DISTRICT COURT SYSTEM. THESE COURTS WOULD REPLACE THE CHARLOTTESVILLE <br /> MUNICIPAL COURT AND THE ALBEMARLE COUNTY COURT. THE LEGISLATION AS PASSED <br /> CALLS FOR THE CREATION OF DISTRICT COURTS BY THE GENERAL ASSEMBLY PRIOR TO <br /> JULY 1~ 1973. THEREAFTER~ ALL JUDGES CURRENTLY IN OFFICE WILL CONTINUE IN <br /> <br /> OFFICE UNTIL THEIR TERMS EXPIRE. THEY MAY BE REAPPOINTED BY THE COURTS OF RECORD <br /> UPON THE EXPIRATION OF THEIR TERMS ONLY WITH THE APPROVAL OF THE COMMITTEE <br /> OF THE COURTS NOT OF RECORD OF THE G~NERAL ASSEMBLY. THERE IS TO BE A <br /> TRANSITIONAL PERIOD DURING WHICH PART TIME JUDGES CONTINUE TO SERVE~ BUT ALL <br /> JUDGES ARE EXPECTED TO BE FULL TIME BY I980, <br /> <br /> THE RESOLUTION OF THE CHARLOTTESVILLE-ALBEMARLE BAR ASSOCIATION CALLS <br /> FOR THE IMPLEMENTATION OF THE DISTRICT COURT PLAN IN THIS AREA AS SOON AS <br /> POSSIBLE. YOUR COMMITTEE FEELS THAT THE APPOINTMENT OF FULL TIME JUDICIAL <br /> PERSONNEL FOR THE MUNICIPAL COURT AND THE COUNTY COURT CAN BE~; IMPLEMENTED <br /> MORE EASILY IF THE TERMS OF THE MUNICIPAL COURT IN CHARLOTTESVILLE AND THE <br /> COUNTY COURT IN ALBEMARLE COINCIDE, <br /> <br /> AT PRESENT~ THE TERMS OF BOTH JUDGES ARE FOR FOUR YEARS. THE MUNICIPAL <br /> COURT TERM EXPIRES DECEHBER 31~ 1973 AND THE COUNTY COURT TERM EXPIRES <br /> JUNE 30~ 1974. THE COUNTY TERMS ARE EXTABLISHED BY STATE STATUTE AND THUS <br /> BEYOND THE CONTROL OF THE LOCAL GOVERNING BODIES. IT IS~ THEREFORE~ <br /> RECOMMENDED THAT THE CITY CHARTER BE AMENDED SO AS TO MAKE THE TERM OF THE <br /> MUNICIPAL JUDGE COINCIDE WITH THAT OF THE COUNTY JUDGE, <br /> <br /> ON MOTION BY MR. GILLIAM~ SECONDED BY MR. BARBOUR A PUBLIC HEARING WAS <br /> SET FOR DECEMBER 4~ i972 AT 7:3O P,M. TO CONSIDER THE PROPOSED CHANGE TO <br /> <br />SECTION 33. <br /> <br /> THE PROPOSED FLOOD PLAIN ORDINANCE WAS PRESENTED AND CONSIDERED~ A <br /> <br />NUMBER OF PEOPLE ADDRESSED THE COUNCIL IN OPPOSITION TO THE PROPOSED ORDINANCE. <br /> <br />A ~OTION BY MR. BARBOUR~ SECONDED BY MR. VAN YAHRES~ THAT THIS PROPOSAL BE <br />TABLED FOR FURTHER STUDY AND DISCUSSED AT A FUTURE WORK SESSION WITH THE <br />PLANNING COMMISSION~ WAS UNANIHOUSLY ADOPTED. <br /> <br /> <br />
