CHARLES L.BARBOUR <br />MR. FRANCIS H. FIFE <br />MR. GEORGE H. GILLIAM <br />MRS. JILL T. RINEHART <br />MR. MITCHELL VAN YAHRES <br /> <br /> TAKE NOTICE <br /> <br /> A SPECIAL MEETING OF THE COUNCIL WILL BE HELD TOMORROW THE 27TH INST. AT <br />12:00 O'CLOCK. <br /> <br /> 1. TO CONSIDER LAND FILL CONTRACT. <br /> 2. RESOLUTION OF CONDEMNATION OF IVY LAND FILL. <br /> 3. NOTICE TO WHITFIELD MORRIS OF CANCELLATION OF CONTRACT. <br /> BY ORDER OF <br /> <br /> r J. S. RUSH, Jr. (SIGNED) CHARLES L. BARBOUR (SIGNED) <br /> CLERK PRESIDENT <br /> <br /> THE COUNCIL MET IN SPECIAL SESSION ON THIS DATE WITH THE FOLLOWING MEMBERS <br /> PRESENT: MR. BARBOUR, MR. GILLIAM, MRS. RINEHART AND MR. VAN YAHRES. ABSENT: <br /> MR. FIFE. <br /> <br /> A CONTRACT FOR JOINT USE AND JOINT OWNERSHIP OF THE IVY LANDFILL BY THE CITY <br />AND COUNTY WAS PRESENTED AND DISCUSSED. MR. GILLIAM OFFERED A MOTION TO APPROVE <br />THE COMPROMI,SE AND AUTHORIZE THE MAYOR TO EXECUTE CONTRACT FOR THE JOINT USE, <br />OWNERSHIP AND OPERATION OF THE IVY LANDFILL, THE MAYOR VACATED THE CHAIR TO <br />SECOND THE MOTION. MR. GILLIAM STATED THAT HE CAN APPRECIATE THAT NOBODY IS <br />HAPPY TO HAVE A LANDFILL IN THEIR BACK YARD, BUT DISPOSAL OF SOLID WASTE IS ACUTE. <br />HE ALSO STATED THAT THE TIME IS LONG PAST FOR THE CITY AND COUNTY AND POSSIBLY <br />THE UNIVERSITY TO EXPLORE ALL MEANS OF SOLID WASTE DISPOSAL. MR. VAN YAHRES <br />STATED THAT WITH RELUCTANCE HE HAS COME TO THE CONCLUSION THAT HE CANNOT VOTE <br />FOR THIS PROPOSITION. HE STATED HIS CONCERN WITH THE ADDED BURDEN ON THE TAX <br />PAYERS OF BUILDING THE ROAD AND ALSO BREAKING FAITH WITH THE PEOPLE OF IVY <br />WHEN WE TOLD THEM IT WAS A TEMPORARY USE. MRS. RINEHART EXPRESSED CONCERN <br />ABOUT SHORT CIRCUITING PROCESS SET IN MOTION BY SUING THE COUNTY. <br /> <br /> A SUBSTITUTE MOTION WAS OFFERED BY MR. GILLIAM, SECONDED BY MR. VAN YAHRES <br />AND UNANIMOUSLY ADOPTED TO TABLE THE PREVIOUS MOTION UNTIL THE FULL COUNCIL WAS <br />PRESENT. <br /> <br /> ON MOTION BY MRS. RINEHART, SECONDED BY MR. VAN YAHRES THE COUNCIL VOTED <br /> <br />TO GO INTO EXECUTIVE SESSION TO DISCUSS LAND ACQUISITION AND POSSIBLE LITIGATION, <br />BY THE FOLLOWING RECORDED VOTE. AYES: MR.BARBOUR, MR. GILLIAM, MRS. RINEHART <br />AND MR. VAN YAHRES. ~BSENT: MR. FIFE. <br /> <br /> ON MOTION THE MEETING ADJOURNED UNTIL SEPTEMBER 30, 1974 AT 5:00 P.M. <br /> <br />ADJOURNED MEETING <br /> <br />IVY LANDFILL <br /> <br />COUNCIL CHAM3ER - SEPTEIVOER 30, 1974 <br /> <br /> THE ADJOURNED MEETING OF SEPTEMBER 27, 1974 WAS RECONVENED ON THIS DATE <br />WITH THE FOLLOWING MEMBERS PRESENT: MR. BARBOUR, MR. FIFE, MR. GILLIAM, MRS. <br />RINEHART AND MR. VAN YAHRES. ABSENT: NONE. <br /> <br /> MR. JACK CAMBLOS ADDRESSED THE COUNCIL AND STATED HIS CONCERN ABOUT THE <br />CITY USING THE IVY LANDFILL ON A PERMANENT BASIS WHEN HE INTERPRETED THE COURT <br />ORDER TO GIVE THE CITY ONLY TEMPORARY USE. <br /> <br />MR. JERRY TREMBLAY, ATTORNEY FOR SOME OF THE IVY RESIDENTS, ADDRESSED THE <br />COUNCIL AND STATED THAT IT WAS UNDERSTOOD BY THE PEOPLE OF IVY THAT THE CITY WAS <br /> <br /> <br />
