7 <br /> Mr. Lynch said Mr. Schilling's points are well taken, but noted that Mr. Schwartz, <br />Executive Director of MACAA, has only bee n on the job less than a year and he is trying <br />to set the situation straight. Mr. Lynch said he would be loath to punish someone who <br />inherited the problem. <br /> <br /> Mr. Schilling said the people who would benefit from getting these funds are <br />penalized. <br /> <br /> Mr. Cox asked where MACAA would get the funds, and Mr. Schilling said it <br />would be up to them to raise the funds, and said he feels Council needs to stand up for <br />accountability. <br /> <br /> Responding to a question from Mr. Cox, Ms. Linda Peacock, Assistant City <br />Manager, sa id the funds came from the City over a seven year period. <br /> <br /> Mr. Cox said it is likely that MACAA will come to the City and ask that the City <br />provide the funding. <br /> <br /> Ms. Peacock noted that the funds are one - time only and could not be used for <br />ongoing operati ons. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Richards, the Resolution Forgiving <br />the $54,767.77 Loan to the Monticello Area Community Action Agency was approved by <br />the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards. Noes: Mr. <br />Schilling. <br /> <br />WHEREAS <br /> , between FY 1995 and FY2001, the City appropriated annual <br />funding to the Monticello Area Community Action Agency (MACAA) for the purpose of <br />supporting various youth and family - oriented programs; and <br /> <br />WHEREAS <br /> , all of the funds were not expended during each fiscal year and have <br />accumulated to $54,767.77 and are reported in the MACAA annual financial audit for FY <br />01 as temporarily restricted net deferred assets due the City of Charlottesville; and <br /> <br />WHEREAS <br /> , because these funds were appro priated on an annual basis by the <br />City and delivered to MACAA in prior fiscal years and because the City does not carry <br />any of these unspent, year - end surpluses as receivables on its books; now therefore <br /> <br />BE IT RESOLVED <br /> by the Council of the City of Charl ottesville, Virginia, that <br />the debt of $54.767.77, carried as temporarily restricted net deferred assets on the books <br />of the Monticello Area Community Action Agency (MACAA) is hereby forgiven. <br /> <br />RESOLUTION <br />: AUTHORIZING JAUNT TO RETAIN $17,167 IN SURPLUS <br />FU NDS <br /> <br /> Mr. Schilling said that there is a perception that public money was not closely <br />accounted for by the City. He said he understands that JAUNT has excess funds because <br />ridership is down, and questioned the need for more money if that is the case. Mr . <br />Schilling said that all agency needs for money must be weighed against other needs. He <br />said he is not convinced this is the best use for the money because it was not weighed <br />against other needs. <br /> <br /> Mr. Caravati made a motion to defer the resolution until the next meeting. <br /> <br /> Mr. Lynch said we would effectively be telling agencies they have to spend all of <br />their funds, and he would prefer to have agencies ask to be allowed to use their excess <br />funds. <br /> <br /> Ms. Richards expressed concern about the questioning of a high performing <br />agency. Ms. Richards said that the philosophy of gainsharing encourages departments <br />not to spend all their funds. Ms. Richards said this has been a very significant program <br />and feels it is a matter of trust. <br /> <br />
