10 <br /> Mr. Caravati asked if the BAR is willing to work with this applicant, and if partial <br />demolition would be allo wed. <br /> <br /> Ms. Fenton said that any part of the building that is not the original log structure <br />could be demolished. <br /> <br /> Mr. Lynch asked if the appeal is denied would the applicant be precluded from <br />going back to the BAR, and Ms. Fenton said he could come back t o the BAR. <br /> <br /> Mr. Preston Coiner, member of the BAR, said that the BAR attempted to work <br />with the application, but he only expressed a desire to tear it down and not use the logs in <br />any renovation. <br /> <br /> Mr. Lynch made a motion to approve the resolution upholdi ng the BAR's denial <br />of the demolition permit, Mr. Caravati seconded the motion, and it was approved by the <br />following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. <br />Noes: None. <br /> <br />WHEREAS <br />, pursuant to the Code of the City of Ch arlottesville (1990), as <br />amended, §34 - 567(a)(2), the property located at 114 Lankford Avenue, specifically, the <br />building located thereon, has been deemed by the City Council to be historically, <br />culturally, architecturally or archaeologically important; an d <br /> <br />WHEREAS <br />, on June 12, 2002, the City’s Housing Inspector/Property <br />Maintenance Code Official notified the Owner of the Property that the existing building <br />has become unsafe, to the point of being a public nuisance, and the Housing Inspector <br />ordered the bu ilding to be taken down and removed; and <br /> <br />WHEREAS <br />, the Property Owner applied to the Board of Architectural Review <br />for a certificate of appropriateness authorizing the demolition of the building located on <br />the Property, his request was denied, and the matt er is now before City Council on <br />appeal; and <br /> <br />WHEREAS <br />, Council has considered each of the criteria referenced within City <br />Code §34 - 577(b) and has determined that the circumstances of this application weigh <br />against granting the requested certificate of appr opriateness. <br /> <br />NOW, THEREFORE <br />, this Council hereby deny the Owner’s request for a <br />certificate of appropriateness authorizing the demolition of the building located at 114 <br />Lankford Avenue. <br /> <br />PRESENTATION <br />: JUVENILE & DOMETIC RELATIONS COURT RENOVATION <br /> <br /> Mr. O'Connell asked that Council approve the concept of the Court renovation <br />after the presentation, and noted that the concept has already been approved by <br />Albemarle County. <br /> <br /> Mr. Bill Letteri, Facilities Manager, said the renovations are in the preliminary <br />design phase and the plan has been shared with the Court Study Committee, judges, <br />clerks and court staff. <br /> <br /> Mr.Antonio Fiol - Silva of WRT, presented the design concept and said a hard <br />functional approach was taken. <br /> <br /> Mr. O'Connell said that we do not yet ha ve final cost estimates. <br /> <br /> Responding to a question from Mr. Caravati, Mr. Letteri said a formal contract <br />for renovations is expected to be signed in June of 2003 and the entire amount will have <br />to be encumbered. <br /> <br /> Mr. Lynch asked if parking will be avail able to the public, and Mr. Letteri said <br />there will be at least 20 new public spaces. <br />
