6 <br /> <br />BE IT RESOLVED <br /> by th e Council of the City of Charlottesville, Virginia that a <br />special use permit is hereby approved and granted to allow operation of a child day care <br />center for up to fourteen (14) children. This special use permit is conditioned upon the <br />following: <br /> <br />1. Administ rative approval of a final site plan. <br />2. Maximum enrollment of fourteen (14) children. <br />3. Three off - street parking spaces (including at least one handicapped space) must <br />be provided and paved in accordance with City standards. <br />4. Adequate entry drive must be constr ucted to provide access to the day care center. <br />5. The drop - off area and the play area, with proper fencing, must be shown on the <br />final site plan. <br /> <br />RESOLUTION <br />: SPECIAL PERMIT FOR HIGHER DENSITY AT 222 SOUTH <br />STREET <br /> <br /> Mr. Higgins explained that special permits of this type are not required if the floor <br />area existed at the time of the zoning ordinance adoption, but this did not exist at that <br />time. Mr. Higgins said that five one bedroom apartments are requested, with no parking <br />required. Mr. Higgins said that t he Planning Commission recommended four apartments. <br />Mr. Higgins said that parking and trash were issues, and said that commercial trash <br />pickup is a condition of the special permit. <br /> <br /> Responding to a question from Mr. Schilling, Mr. Higgins said that the r equest <br />was reduced to four units because the Planning Commission was concerned about the <br />adequacy of the fifth basement unit. <br /> <br /> Responding to a question from Mr. Schilling, Mr. Bill Chapman, applicant for the <br />special permit, said that none of the existin g residents have parking, though they are <br />eligible for permit parking. Mr. Chapman said an option is to have residents pay extra to <br />have an assigned parking space on the property. <br /> <br /> Mr. Cox asked about the process for extending the hours of permit parking , and <br />Mr. Higgins said the neighborhood would have to go through the petitioning process. <br /> <br /> Mr. Caravati asked if commercial trash pickup is feasible, and Mr. Higgins said <br />they are not requiring dumpsters, but a pickup system. <br /> <br /> Mr. Caravati asked about dr ainage and pedestrian access issues, and Mr. Higgins <br />said he has not heard anything about drainage problems, but will check to see as that was <br />part of the original site plan. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Schilling, the Special Permit for <br />Highe r Density at 222 South Street was approved by the following vote. Ayes: Mr. <br />Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br />WHEREAS <br />, pursuant to the Code of the City of Charlottesville, section 34 - <br /> <br />464(1), William G. Chapman, on behalf of 220 South Street, LLC, has requested a <br />special use permit to allow additional residential density for property located at 222 <br />South Street, identified on the 2002 City Tax Map 28 as Parcel 95; <br /> <br />WHEREAS <br /> , a joint public hearing on this applicatio n was held before the City <br />Council and Planning Commission on November 19, 2002, following notice to the public <br />and to adjacent property owners as required by law; and <br /> <br />WHEREAS, <br /> this application seeks permission for the owner to convert a building <br />frontin g along South Street (“Original Building”) from commercial to residential use, by <br />establishing therein up to five (5) residential dwelling units (there currently exist five <br />dwelling units within an apartment building constructed in 1994 on the back portion of <br />the property (“Rear Building”)), for a total site density of up to 38.0228 units per acre; <br />and <br />
