7 <br /> Mr. Caravati noted the letter received from the Muscular Dystrophy Association <br />which raises funds in this manner. <br /> <br /> Ms. Kelley said it was originally proposed that panhandling be banned at all <br />intersections, but the Fire Department, which has also rais ed funds in this way, asked that <br />it not be a complete ban. She said the intent is to focus on the location and manner of <br />panhandling, not a particular group. <br /> <br /> Mr. Caravati asked about the implication if the panhandling is done by a sworn <br />public employee, but Ms. Kelley said the concern is about distraction of drivers as well as <br />safety of the public. <br /> <br /> Chief Longo said exceptions should not be made when there are safety concerns. <br /> <br /> Responding to a question from Ms. Richards, Ms. Kelley said the ordinance <br />would prohibit people from holding up signs advertising car washes if it is within a <br />certain distance from these four intersections. <br /> <br /> Mr. Schilling said he has received a number of calls about this issue, and while he <br />thinks it is regrettable that it has to be addressed, he thinks this is a prudent and good <br />approach. <br /> <br />On motion by Mr. Schilling, seconded by Mr. Lynch, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REORDAINING SECTION 28 - 31 OF CHAPTER 28 <br />(STREETS AND SIDEWALKS) PROHIBITING SOLICITTIONS WITHIN CERTAIN <br />CITY RIGHTS - OF - WAY USED FOR VEHICULAR TRAVEL" was offered and <br />carried over to the next meeting for consideration. <br /> <br />APPROPRIATION <br />: $45,526 - DOMESTIC VIOLENCE COORDINATOR GRANT <br /> <br /> Responding to a question from Mr. Lynch, Mr. O'Connell said t hat if the grant <br />runs out, the positions it funds ends. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Lynch, the $45,526 appropriation of <br />the Domestic Violence Coordinator Grant was offered and carried over to the next <br />meeting for consideration. <br /> <br />nd <br />ORDINANCE <br />: UTILITY RATES (2 reading) <br /> <br /> Mr. Lynch proposed an amendment to the ordinance which would sunset set it on <br />November 1. He said he hopes the City, County and Rivanna Water and Sewer Authority <br />can come up with a more equitable financing packet. <br /> <br /> Ms. Ric hards said the report on rates is not due to Council until October 31 and <br />more time will be needed between this and when the rates would sunset. <br /> <br /> Mr. Cox said we would be in danger of having no rate, and argued that the <br />ordinance be sunsetted no earlier t han January. <br /> <br /> Mr. Schilling said he is sympathetic to the motion, but would support sunsetting <br />the ordinance on January 1, and seconded the motion to amend. <br /> <br /> Mr. O'Connell noted that a 30 day notice requirement needs to be built into the <br />process. <br /> <br /> Mr. C raig said that a phase could be added such as "unless re - enacted by Council <br />before that date," and noted that if the rates are not changed, it would not need to be <br />advertised. <br /> <br /> Ms. Richards suggested moving the sunset date to January 31, and Mr. Lynch and <br />Mr. Schilling accepted the amendment. <br /> <br />
