8 <br /> The amendment adding a sunset clause of January 31 was approved by the <br />following vote. Ayes: Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: Mr. <br />Caravati. <br /> <br />The ordinance entitled "AN ORDINANCE TO AMEND AN D REORDAIN <br />CHAPTER 31 (UTILITIES) OF THE CODE OF THE CITY OF CHARLOTTESVILLE, <br />1990, AS AMENDED, RELATING TO UTILITY RATES," as amended, which was <br />nd <br />offered on June 2 , was approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, <br />Ms. Richards, Mr. Schi lling. Noes: Mr. Lynch. <br /> <br />Mr. Lynch said he cannot support the water increases given the structure set up by <br />Rivanna. He said he feels there is $1.5 million of padding in the budget. He said he <br />thinks we are sticking the cost of new infrastructure for C ounty expansion on City <br />residents. <br /> <br />Mr. Schilling said he concurs with Mr. Lynch and will most likely take the same <br />stance at the next vote. However, he said he feels it would have been imprudent not to <br />pass the ordinance because of the impact on water se rvice. <br /> <br />ORDINANCE <br />: TELECOM FRANCHISE - MARTHA JEFFERSON HOSPITAL <br /> <br /> Mr. Lynch noted that as part of the agreement Martha Jefferson Hospital will be <br />providing fiber optic cable to the Meadowcreek Golf Pro Shop. He asked why it is <br />proposed to be taken there , and questioned if that is the highest and best use of the <br />$18,000 value. He asked that this be justified, and said DSL could be done for less <br />money. <br /> <br /> Ms. Richards agreed and said it could be strung somewhere else. <br /> <br /> Mr. O'Connell said that this was an effort to get some service back as a result of <br />the agreement, and noted that this is not a legal requirement on the part of Martha <br />Jefferson Hospital. Mr. O'Connell recommended that Council do a first reading on the <br />ordinance and more information will be provided prior to the second reading, including <br />more information on the process and legalities. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Richards, the ordinance entitled <br />"AN ORDINANCE GRANTING A FRANCHISE TO MARTHA JEFFESON <br />HOSPITAL, ITS SUCCESSORS AN D ASSIGNS, TO USE CERTAIN PUBLIC <br />PLACES OF THE CITY OF CHARLOTTESIVLLE, VIRGINIA, FOR A FIBER OPTIC <br />CONNECTION BETWEEN 459 LOCUST AVENUE AND 595 PETER JEFFERSON <br />PARKWAY FOR A PERIOD OF FIVE (5 YEARS)" was offered and carried over to the <br />next meeting for co nsideration. <br /> <br /> Mr. Schilling said he has the same question and opposes this. He said he was told <br />the policy is to put fiber optic into these different areas, but he think staff should check <br />with Council about policy. <br /> <br />PUBLIC <br /> <br /> Mr. Peter Kleeman, 407 Hedge Street, noted that the original resolution regarding <br />Fontaine Avenue was very different from the one Council approved. He said he thinks it <br />is problematic asking for both a two and three lane road on Fontaine. He said the MPO is <br />the appropriate forum fo r discussion of this type project, and he feels to have it driven by <br />a Commissioner is outside the realm of good public policy. He said transportation mode <br />issues should be linked when asking for transportation review, and transit solutions <br />should be incl uded. <br /> <br /> Mr. Kevin Kotlarski, 2316 Fontaine Avenue, said his main concern is that the <br />1997 plan for Fontaine Avenue is still being supported even though there are several <br />discrepancies between it and the current plan. He said he is still looking to have t hat <br />addressed. <br /> <br />
