8 <br /> Mr. Schilling said if done appropriately and equitably, if we take more time , and <br />if there is a public hearing, he could support the ordinance. <br /> <br />REPORT <br />: ZONING ORDINANCE <br /> <br /> Mr. Tolbert reviewed the most recent changes made to the zoning ordinance and <br />the schedule of other projects. Mr. Tolbert said the final draft will be availa ble on - line by <br />nd <br />the end of the week and a public hearing will be advertised for September 2 . <br /> <br /> Mr. Cox suggesting adding the Housing Policy Task Force recommendations <br />when they are completed. He asked when the parks designation issue will be considered. <br /> <br /> Mr. Tolbert said the Planning Commission will consider parks designation next <br />week and it can be considered by Council in September. <br /> <br /> Ms. Richards said she continues to support the idea of expanding the area for the <br />three unrelated person rule and would like it to apply to R - 2 zones as well as the <br />University districts. She said a bigger area is needed or it is not going to work. <br /> <br /> Mr. Cox said there must be a way to identify how we can systematically convert <br />back to homeownership. <br /> <br /> Mr. Caravati said he has some concerns about the restrictions on accessory <br />apartments and does not think they are right or just. He said if we really want accessory <br />apartments we need to change the square footage requirement. He said he does not think <br />only homeowners should be allowed to have them. <br /> <br /> Mr. Brown said that from an historical perspective, and from legal advice given in <br />1991, he has concerns about the enforceability of the owner occupied requirement for <br />accessory apartments. He said zoning regulates use, not who uses it. He said the purpose <br />of allowing the accessory apartments was to allow people on fixed incomes to have an <br />additional income and be able to stay in their homes. <br /> <br /> Mr. Lynch said it provides affordable rental opportunities. Mr. Lynch expressed <br />conc ern about conveyance of common property in a PUD. He said when the common <br />property is conveyed to the homeowner association that is okay, but the ordinance talks <br />about any sale. He said some provision ought to be put in that common property cannot <br />be rem oved without going to the Planning Commission. <br /> <br /> Mr. Brown said that removing common property would trigger a site plan <br />violation. <br /> <br /> Mr. Caravati said he disagrees with the memorandum written by Ms. Lisa Kelley, <br />Deputy City Attorney, about communication to wers, but is okay with the rest of the <br />changes. <br /> <br /> Mr. Lynch said that five houses on Lexington Avenue are shown as part of the <br />downtown corridor, and asked if they should remain B - 1 until the survey is done. <br /> <br /> Mr. Caravati said this is not really an issue. Mr. Caravati suggested that staff <br />notify people who have had specific concerns and those who served on the original focus <br />groups about the upcoming public hearing. <br /> <br /> Mr. Lynch said he wants to make sure that the new development step back covers <br />all corri dors. <br /> <br />MINUTES <br /> <br />th <br /> Mr. Lynch asked that the minutes of the July 17 work session be amended to <br />include language to reflect approval of consensus issues in the zoning ordinance. <br /> <br />
