11 <br /> Mr. Caravati said he will not support it because other properties owners will not <br />contribute financially. <br /> <br /> Mr. Schilling made a mo tion to defer the appropriation until a letter can be sent to <br />other property owners asking for their contribution, and Mr. Caravati seconded the <br />motion. <br /> <br /> Mr. O'Connell said that Council needs to understand that the City is under <br />contract for the work and has followed City policy. <br /> <br /> The motion to defer the appropriation was defeated by the following vote. Ayes: <br />Mr. Caravati and Mr. Schilling. Noes: Mr. Caravati, Mr. Cox, Mr. Lynch. <br /> <br /> Mr. Lynch made a motion to approve the appropriation and asked Council to <br />contact adjacent property owners. <br /> <br /> Mr. Schilling questioned what incentive property owners have if Council <br />approves the appropriation. <br /> <br /> Mr. Cox seconded the motion, and the appropriation was carried over to the next <br />meeting for consideration. <br /> <br /> Mr. Lynch said he is generally not in favor of spending money on <br />undergrounding. <br /> <br /> Mr. Cox said the Paramount should not be penalized for failure of other property <br />owners to participate. <br /> <br />ORDINANCE <br />: PARKING - DISTANCE FROM CURB <br /> <br /> Ms. Richards said that parkin g close to the curb presents a special challenge for <br />the elderly, vertically challenged and disabled. She said she feels a better measure of <br />distance would be from the curb to the driver's side of the car. <br /> <br /> Mr. Schilling said he shares these concerns and feels that parking 12 inches from <br />the curb is difficult given the hills and curves in Charlottesville. He said the problem <br />with Ms. Richards' suggestion is that many cars would be too large to fit. He suggested <br />that the distance be changed to 18 inches from the curb. <br /> <br /> Mr. O'Connell noted that Council had asked staff to go back and ask the Police <br />Department for their recommendation, and they recommended 12 inches. <br /> <br /> Ms. Lisa Kelley, Deputy City Attorney, said that while Ms. Richards point is well <br />taken, the Police are concerned about infringement into the travel lanes. She said Ms. <br />Richards' idea may outlaw certain vehicles. <br /> <br /> Mr. Caravati made a motion to approve the ordinance, requiring 12 inches from <br />the curb, and Mr. Cox seconded the motion. <br /> <br /> Mr. Sc hilling made a substitute motion to require parking 18 inches from the <br />curb, and Ms. Richards seconded the motion. <br /> <br /> Mr. Schilling's substitute motion was approved by the following vote. Ayes: Mr. <br />Lynch, Ms. Richards, Mr. Schilling. Noes: Mr. Caravati and Mr. Cox. <br /> <br />The ordinance entitled "AN ORDINANCE AMENDING AND REORDAINING <br />SECTION 15 - 136 OF ARTICLE V, CHAPTER 15 (MOTOR VEHICLES) OF THE <br />CODE OF THE CITY OF CHARLOTTEVILLE, 1990, AS AMENDED, RELATING <br />TO PARKING OF VEHICLES," requiring parking within 18 inches of the curb, was <br />offered and carried over to the next meeting for consideration. <br /> <br /> <br />
