Noes: Mr. Cox and Mr. Lynch. <br /> <br /> Mr. Lynch suggested that the CTB be given last year's statement and be told that a <br />new one is coming. <br /> <br /> Mr. O'Connell said it is his understanding that the CTB is looking at the City's top <br />five projects. <br /> <br /> Mr. Lynch said he disagrees with that and does not think we should focus on only <br />the City's projects. <br /> <br /> Ms. Richards said that the CTB is asking for the City's priorities for the City's <br />urban road allocation. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Caravati, the resolution requesting <br />VDOT award an urban system highway project for the bridge rehabilitation of the <br />Belmont Street Bridge was approved by the following vote. Ayes: Mr. Caravati, Mr. <br />Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br />WHEREAS <br />, in accordance with Virginia Department of Transportation <br />construction allocation procedures, it is necessary that a request by council resolution be <br />made in order that the Department approve an urban hi ghway project in the City of <br />Charlottesville; now, therefore <br /> <br />BE IT RESOLVED <br /> , that the Council of the City of Charlottesville, <br />Virginia requests the Virginia Department of Transportation to award an urban system <br />th <br />highway project for the bridge rehabilitati on of the Belmont Street Bridge at 9 <br />Street/Avon Street. <br /> <br /> BE IT FURTHER RESOLVED <br /> , that the Council of the City of Charlottesville <br />hereby agrees to pay its share of the total cost for preliminary engineering, right of way <br />and construction of this proj ect in accordance with Section 33.1 - 44 of the Code of <br />Virginia, and that, if the City of Charlottesville subsequently elects to cancel this project, <br />the City of Charlottesville hereby agrees to reimburse the Virginia Department of <br />Transportation for the to tal amount of the costs expended by the Department through the <br />date the Department is notified of such cancellation. <br /> <br />nd <br />ORDINANCE <br />: ZONING ORDINANCE (2 reading) <br /> <br /> Mr. Tolbert said that the zoning ordinance will be monitored to assure that it has <br />the impact s we think it will have, and an annual report will be made to Council. Mr. <br />Tolbert said that additional historic districts will be brought into the ordinance as surveys <br />are done, and environmental regulations will be added as well as recommendations <br />comin g out of the Housing Policy Task Force. <br /> <br /> Mr. Schilling said that item #14 on Amendment list A is a discussion item only. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Schilling, the zoning ordinance was <br />amended to include items #1 - 17, minus #14 on listing A , by the following vote. Ayes: <br />Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br /> Mr. Caravati asked for the City Attorney's opinion on restricting accessory <br />apartments to owner occupied structures. <br /> <br /> Ms. Lisa Kelley, Deputy City Attorney, explained that the City Attorney's office <br />was asked for an opinion on the enforceability of allowing accessory apartment only in <br />owner occupied structures. She said that in Virginia the focus of zoning is what is done <br />
