102 <br />APPROPRIATION <br />d. : $182,500 - Drug Court Grant (carried over) <br /> <br />ORDINANCE <br />e. : "AN ORDINANCE AMENDING AND REORDAINING <br />SECTION 15 - 246 OF ARTICLE VI, CHAPER 15 OF THE <br />CHARLOTTESVILLE CITY CODE, 1990,A S AMENDED, RELATING TO <br />RIDING OF BICYCLES ON THE DOWNTOWN M ALL BY EMERGENCY <br />nd <br />SERVICES PERSONNEL" (2 reading) <br /> <br />PUBLIC HEARING/ORDINANCE <br />: TOWE PARK TENANT LEASE <br /> <br /> Mr. O'Connell explained that Albemarle County Parks Department manages <br />Towe Park, and the tenant house within the Park is being leased. Mr. O'Connell s aid the <br />rent is reduced due to tenant work responsibility associated with the park. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> Mr. Schilling said that in reviewing the information provided, he was pleas ed that <br />it contained most of the information that concerned him in previous lease situations. <br /> <br /> Responding to a question from Ms. Richards, Mr. Pat Plocek, Parks Manager, <br />said that the lease is for one year, renewable up to five years. <br /> <br />On motion by Mr. Ly nch, seconded by Mr. Caravati, the ordinance entitled <br />"ORDINANCE APPROVING LEASE AGREEMENT FOR TOWE PARK TENANT <br />HOUSE" was offered and carried over to the next meeting for consideration. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: CONVEYANCE OF CASTALIA STREET <br />RIGHT - OF - WA Y <br /> <br /> Mr. O'Connell explained that the owners of the property have requested that a <br />1,875 square foot portion of City property be conveyed to them because their shed and a <br />fence encroach on the property. He explained that the City has reserved an easement. <br />The property is assessed at $3 per square foot, but staff recommend that the owners not <br />be charged for the property. <br /> <br /> Mr. Brown said that staff recommend that only 1,250 square feet be conveyed, <br />less than originally requested, in order to accommodate a s idewalk should the City want <br />to add one in the future. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> Mr. Brown said that the property owner will be responsible for preparing the final <br />plat. <br /> <br /> Mr. Caravati asked if the shed will still meet the sideyard setback, and Mr. Brown <br />said he will provide that information at the second reading of the ordinance. <br /> <br /> Responding to a question from Mr. Lynch, Mr. Brown said that a consent of <br />encroachment was granted to the prior owner, but it is not of record. Mr. Brown said this <br />is not viewed as something that runs with the property. <br /> <br /> Mr. Schilling said he has looked at the property and has no objection to the sale, <br />but it has turned from a sale to a gift which he opposes . He said he understands the <br />applicants want a clear sale. He said in looking at the history of the property, it sold 10 <br />years ago to the current owners for $86,000 and is now on the market for $289,000. He <br />said he feels it is more reasonable to sell th e property. He said the City is at no fault in <br />this situation and the land is a good addition to the lot. Mr. Schilling said based on the <br />facts he feels it is most reasonable to cure the problem by selling the property. <br /> <br />
