10
Ms. Richards said that three Councilors asked fo r an opinion and did not think
they needed more than a majority to make the request. She said the three Councilors felt
it was important to the public to clarify the legality of the issue. She said the City has
received verbal confirmation that an easeme nt is legal. She said she will abide by the
decision of the Attorney General and said we need to reassure the community that such
action is lawful. She said the Attorney General's office is staffed by professionals and
she does not believe they will rend er politically motivated judgments. She said it seems a
small step to ask for written confirmation.

Mr. Cox said he is disturbed that Councilors have worked to create operating
guidelines and then they are violated.

Mr. Lynch said there is a wider iss ue than following the guidelines with three
Councilors asking staff to take action when Council did not vote on it.

Ms. Richards said she cannot believe Mr. Cox and Mr. Lynch think it is wrong to
seek an opinion from the Attorney General for something th ey have questioned the
legality of.

Mr. Cox said it does not have to go to the Attorney General and said we can get
an opinion from another attorney.

Ms. Richards said this is an attempt to get to the public just what the law has to
say.

The meeting was adjourned.

______________________________ ___________________________
President Clerk
