10 <br /> Mr. Lynch said he likes the way the townhous es look and asked to what extend <br />will there be that level of design. <br /> <br /> Mr. Runkle said the product will be controlled through an architect. He said there <br />will be variation because of the site. <br /> <br /> Mr. Lynch asked if Mr. Runkle is open to input from neighbor s, and Mr. Runkle <br />said he is open to input but not control. <br /> <br /> Ms. Richards said there is a need for affordability in the City, though she <br />understands the neighbors' concern about affordability and fear of transition to student <br />housing. She said she would like to see the number of townhouses reduced and <br />th <br />suggested that the number of townhouses be increased on the 5 Street site. <br /> <br /> Mr. Runkle said his goal is to have as much flexibility on the site as possible. <br /> <br /> Responding to a question from Mr. Cox, Mr. Ru nkle said the entire project is <br />expected to take three years, with part being developed this summer and early fall. <br /> <br />On motion by Mr. Lynch, seconded by Ms. Richards, the ordinance entitled "AN <br />ORDINANCE AMENDING THE PUD ZONING OF TM 22A, PARCEL 3 AND TM <br />2 2B, PARCELS 177 - 182, (THE "JOHNSON VILLAGE PUD") PREVIOUSLY <br />APPROVED BY CITY COUNCI ON MARCH 1, 2004" was offered and carried over to <br />the next meeting for consideration. <br /> <br />ORDINANCE <br />: REZONING RIVERSIDE AVENUE PROPERTY TO PUD <br /> <br /> In response to a question fro m Mr. Caravati, Mr. Tolbert said that this item is <br />being taken up at this time because it was voluntarily deferred from the February <br />Planning Commission agenda and the applicant has some closing issues. <br /> <br /> Mr. Schilling said he is uncomfortable moving forwa rd having just seen the <br />ordinance. <br /> <br /> Ms. Claudette Grant, Planner in Neighborhood Development Services, said the <br />proposal is to rezone 19.5 acres at the north end of Riverside Avenue from R - 2 to PUD <br />for 22 single family units. Ms. Grant noted this is a lo wer density than allowed by right. <br />Proffers include deeding an easement to the City, adding a pedestrian access trail to the <br />Greenbelt Trail, and $10,000 toward the construction of a sidewalk on Chesapeake Street. <br />Ms. Grant said the applicant has request ed the right to construct accessory apartments. <br />Ms. Grant said that the Planning Commission unanimously approved the rezoning. She <br />noted that there had been a question about maintenance of the trail, and said the <br />developer will maintain the trail. <br /> <br /> Mr. Brown said the ordinance presented to Council is the standard form ordinance <br />for PUD rezonings. Mr. Brown said the only City obligation is to maintain the easement <br />if the City makes improvements. <br /> <br /> Mr. Lynch noted that the proffer statement referred is da ted February 25, but Mr. <br />Brown said Council can come back and amend that at the second reading. <br /> <br /> Mr. Lynch asked about plans to identify and protect trees. <br /> <br /> Mr. Richard Price, applicant, said the intent of the plan is to minimize grading and <br />loss of tree s. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Richards, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REENACTING THE ZONING DISTRICT MAP <br />INCORPORATED IN SECTION 34 - 1 OF THE ZONING ORDINANCE OF THE <br />CODE OF THE CITY OF CHARLOTTESIVLLE, 1990 (AS AMENDED), BY THE <br />REZONING OF TM 551, PARCEL 88.1 FROM R - 2 TO PUD (RIVERWALK PUD)," <br />
