11 <br />with the February 25 proffer date was offered and carried over to the next meeting for <br />consideration with the expectation that the proffer is subject to an update. <br /> <br />ORDINANCE <br />: REZON ING RIVERSIDE AVENUE AND CHESAPEAKE AVENUE <br />PROPERTY TO PUD <br /> <br /> Ms. Grant said the request is to rezone .98 acres at the corner of Riverside and <br />Chesapeake Avenue from R - 2 to PUD and to build 5 single family units. She said this is <br />a slightly lower density t han allowed by right. Proffers include making improvements to <br />the storm water channel within three years, granting a permanent drainage easement to <br />the City, and contributing $5,000 for a sidewalk on Chesapeake Street. Ms. Grant said <br />the developer has re quested the right to construct accessory apartments. Ms. Grant said <br />the Planning Commission approved the rezoning request, with one member voting <br />against the rezoning. <br /> <br /> Mr. Caravati said he would like to know why Ms. Firehock, Planning <br />Commission member, voted against the rezoning. <br /> <br /> Responding to a question from Mr. Lynch, Mr. Chris Hayes, applicant, said the <br />survey of trees has been done and the plan is to keep as many native species as possible. <br />He noted there are not many nature specimens on the prop erty. <br /> <br /> Mr. Schilling said the request to waive on site parking could result in 15 to 20 <br />cars on the street, and said he may not be persuaded to pass the ordinance as proposed. <br /> <br /> Mr. Tolbert said a parking waiver is recommended for five spaces. He said st aff <br />feel there is plenty of room for five vehicles on the street. He said if accessory <br />apartments are added, the applicant would have to come back to request additional <br />parking space waivers. <br /> <br /> Mr. Hayes said they are actually only asking for a waiver of four spaces. He said <br />13 spaces are available for the first phase. <br /> <br />On motion by Mr. Lynch, seconded by Ms. Richards, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REENACTING THE ZONING DISTRICT MAP <br />INCORPORATED IN SECTION 34 - 1 OF THE ZONING ORDINANCE OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1990 (AS AMENDED) BY THE <br />REZONING OF TM 55A, PARCEL 88.8 FROM R - 2 TO PUD (RIVERSIDE AND <br />CHESAPEAKE PUD)" was offered and carried over to the next meeting for <br />consideration. <br /> <br />Mr. Cox said he appreciates the develo pers' sensitivity on these two sites. <br /> <br />RESOLUTION <br />: FAIR HOUSING <br /> <br /> Ms. Missy Creasy, Planner in Neighborhood Development Services, said <br />language has been revised since Council discussed the resolution at its previous meeting <br />to address concerns about group homes. Ms. Creasy said that there are approximately <br />four licensed child group homes in Charlottesville, and 23 adult group homes, and five <br />licensed child group homes in Albemarle County, and 10 adult group homes. Ms. Creasy <br />said this includes nursing ca re facilities. Ms. Creasy said a statement adding sexual <br />orientation to the discrimination statement has been included, though there is some <br />question about whether it can be added. She said this will be clarified. She said a <br />disclaimer about the census i nformation was also added. <br /> <br /> Mr. Caravati noted that speakers earlier in the meeting were concerned about our <br />interpretation of assisted living facilities being allowed in neighborhoods. <br /> <br /> Ms. Creasy said legal advice was given to staff on the issue. <br /> <br /> Mr. Cox said he still has questions about the Virginia Neurocare facility. He <br />asked that additional legal information be provided to Council. <br />
