5 <br /> Mr. Cox said that an attempt will be made to schedule a work session. <br /> <br />PUBLIC HEARING/ORDINANCE <br />: RELEASE GAS EASEMENT - RIVANNA <br />RIDGE <br /> <br /> Ms. Renee Knake, Assistant City Attorney, explained that in 2001 a permanent <br />easement was granted to the City. S he said a new building is proposed which will require <br />relocation of the gas lines. She said the developer will pay the full cost of the relocation <br />and Council needs to approve abandonment of the easement. <br /> <br /> The public hearing was opened, but as there were no speakers, the public hearing <br />was closed. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Richards, the ordinance entitled <br />"AN ORDINANCE AUTHORIZING THE ABANDONMENT OF A NATURAL GAS <br />EASEMENT GRANTED TO THE CITY BY PANTOPS, GIANT, LLC" was offered <br />and carr ied over to the next meeting for consideration. <br /> <br />REPORT <br />: MEADOWCREEK PARKWAY <br /> <br /> Mr. Brown explained that the City received an Attorney General opinion that <br />Council can transfer title for the land for the Meadowcreek Parkway to VDOT by simple <br />majority. He said he believes that conveyance via an easement to VDOT is also an <br />option. He said another alternative is that there be no land transfer, but a contractual <br />agreement, with the City assuming responsibility for design, right of way acquisition and <br />construc tion for the Parkway. He said that if Council wants to pursue that alternative a <br />th <br />resolution must be presented to the State by June 30 . <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, said that there <br />will be guidelines for management of the urban allocation, and if Council approves the <br />resolution by June 30, the City would be eligible on July 1, 2005. If the resolution is <br />approved, there would be negotiation over the next year between the City and State on <br />an agreement. He said VDOT w ill remained involved in the process and they will have <br />design and consultant approval, and their procurement process must be followed. He said <br />the City would have administrative review, legal review, and finance involvement, which <br />are not defined yet. H e said there will be additional responsibility for the City, but that <br />likely will be eligible for project funding. Mr. Tolbert said that staff recommends that <br />Council approve a resolution opting into the program which will not be binding, and the <br />City wil l have until next year to commit. He said it also appears that this would give the <br />City the ability to move money between projects that are in the six year plan. He said <br />that VDOT has said that money could be moved from the Fontaine Avenue project for a <br />Meadowcreek Parkway interchange study as long as the request is made this week. He <br />said discussion had been to tentatively move $1 million. <br /> <br />
