The motion to deny the r ezoning was denied by the following vote. Ayes: Mr. <br />Caravati and Mr. Schilling. Noes: Mr. Cox, Mr. Lynch, Ms. Richards. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Richards, the ordinance rezoning <br />1013 Linden Avenue from R - 2 Residential to Highway Corri dor District was offered and <br />carried over to the next meeting for consideration. <br /> <br />ORDINANCE <br />: REZONING MADISON AVENUE AND MEADOW STREET <br />PROPERTY TO PUD <br /> <br /> Mr. Caravati said that Council has a year to deal with this request and he would <br />like to postpone it for at least one meting. He said he is not confident given what went on <br />in the first phase of the development that the drainage will work. He also expressed <br />concern about the proffer statement which refers to there being no side yard setback. <br /> <br /> Mr. Cox s aid he does not think anything will be gained by stalling the work for <br />two weeks. Mr. Cox said he thinks this will be a major asset to the Rose Hill <br />Neighborhood. <br /> <br /> Responding to a question from Mr. Schilling, Mr. Tolbert said that the drainage <br />work from the first phase has not been accepted and staff continues to work with the <br />developer on this. Mr. Tolbert said the problem is not with the design but with the <br />installation. Mr. Tolbert said a detailed site plan has not been submitted. <br /> <br /> Mr. Caravati said he cannot support this rezoning until a master plan is in place. <br />He said he does not believe it meets the Comprehensive Plan requirements. <br /> <br /> Mr. Schilling said he saw egregious destruction of neighborhoods while living in <br />California and is concerned of t hat happening here. He said he thinks having no side <br />yard setbacks will not be good in this project. He asked about the practical advantage of <br />delaying the rezoning request. <br /> <br /> Mr. Caravati said he would like to see implementation of phase one is a workma n <br />like manner and a master plan for the open space. <br /> <br /> Responding to a question from Mr. Lynch, Mr. Tolbert said there is a discrepancy <br />between the concept plan and proffer statement with regard to the side yard setback. <br /> <br /> Mr. Lynch said he thinks it is a l egitimate concern. <br /> <br /> Mr. Tolbert said Council can defer the rezoning or can have a first reading and get <br />clarification between the first and second readings. <br /> <br /> Ms. Richards agreed that legitimate issues have been raised, and said she would <br />like clarificati on prior to the second reading. <br /> <br /> On motion by Ms. Richards, seconded by Mr. Cox, the ordinance rezoning <br />Madison Avenue and Meadow Street property to PUD was offered and carried over to the <br />next meeting for consideration. <br /> <br /> Mr. Caravati said he would like to see the master plan. <br /> <br /> Mr. Cox said a master plan for open space is not something required on other <br />projects. <br /> <br />ORDINANCE <br />: AMENDMENTS TO SIDWALK CAFÉ ORDINANCE <br /> <br />
