16 <br /> Mr. Lynch asked about removing winter use of cafes, and Mr. Tolbert said that <br />two years ago cafés were allowed to remain through the winter. Mr. Tolbert said this <br />policy was reviewed and it is not recommended to continue because the cafes were not <br />taken care of and there were very few days that they had any use. He said the season has <br />th <br />been ext ended to December 15 . He said the cafes became storage areas for furniture. <br /> <br /> Mr. Lynch said he feels the days the cafes were open in the winter were <br />worthwhile, and he does not have a problem with the spaces being used to store furniture. <br />He said the cafes bring life to the mall in the winter. <br /> <br /> Mr. Tolbert said consideration could be given to allowing heated tents year round. <br /> <br /> Responding to a question from Mr. Lynch, Mr. Tolbert said that the City has no <br />electric power to supply to cafes, and Mr. O'C onnell noted that the power has been <br />disconnected. <br /> <br /> Mr. Cox said he would like to see the issue of tents explored. <br /> <br /> Mr. Tolbert said the code could be amended to allow them. <br /> <br /> On motion by Ms. Richards, seconded by Mr. Schilling, the ordinance amending <br />t he sidewalk cafe ordinance was offered and carried over to the next meeting for <br />consideration. <br /> <br />RESOLUTION <br />: AMENDED SPECIAL PERMIT FOR 805 ALBEMARLE STREET <br /> <br /> Ms. Kelley explained that one recommendation was changed by the Planning <br />Commission and the ten dog limit was deleted, but this was not reflected in the resolution <br />approved by Council. Ms. Kelley said Council can amend the resolution to delete the <br />limit, refer the matter back to the Planning Commission, or decline to take further action. <br /> <br /> Mr. Schil ling made a motion to amend the permit to delete the ten dog limit, per <br />staff recommendation, and Ms. Richards seconded the motion. <br /> <br /> The resolution amending the special permit for 805 Albemarle Street was <br />approved by the following vote. Ayes: Mr. Cox, M r. Lynch, Ms. Richards, Mr. <br />Schilling. Noes: Mr. Caravati. <br /> <br />WHEREAS <br />, pursuant to the Code of the City of Charlottesville, on August 18, <br />2003 Mr. Bill Nitchman, on behalf of Canvasback Real Estate & Investment LLC, <br />requested a special use permit to allow property located at 805 Albemarle Street, <br />identified on the 2002 City Tax Map 35 as Parcel 57.1 (“Subject Property”) to be used for <br />an animal boarding or grooming facility with outside runs or pens; <br /> <br />WHEREAS <br /> , a joint public hearing on this application, SP - 03 - 08 - 07, was held <br />before the City Council and Planning Commission on September 9, 2003, following <br />notice to the public and to adjacent property owners as required by law; and <br /> <br />WHEREAS, <br /> subsequent to the public hearing, the applicant has decided not to <br />utilize the Subject Property itself as a dog grooming facility; however, the applicant still <br />wishes to obtain a special use permit authorizing use certain of certain yard area(s) of the <br />Subject Property as an outside run or pen for an animal boarding and t raining center <br />located on adjacent property, 706 Henry Avenue; and <br /> <br />WHEREAS, <br />on April 13, 2004 the Owner obtained the Planning Commission’s <br />approval of a final site plan for 805 Albemarle Street (subject to approval of a Special <br />Use Permit) showing the use of the yard area(s) of the Subject Property as an outside run <br />or pen associated with the animal boarding and grooming facility located at 706 Henry <br />Avenue; and <br /> <br />
