7 <br /> Mr. Peter Kleeman, 407 Hedge Street, expressed concern about the procedure and <br />said there is little information available. He said expertise w ill be needed and this could <br />place a burden on staff. He said it does not bode well for high quality products. He <br />suggested that Council think about doing this for next year. <br /> <br /> As there were no further speakers, the public hearing was closed. <br /> <br /> Mr. Lynch said he understands that VDOT wants the equivalent of a letter of <br />intent. He said he agrees with Mr. Schilling that the resolution implies that we are closer <br />than we are to a final agreement. He said he also agrees with Mr. Kleeman that there are <br />a lot of unknowns. He said it is not clear we can reprogram the allocation, and if we <br />cannot, he does not see much benefit. <br /> <br /> Mr. Caravati said he thinks the language in the resolution is clear and it is clear <br />that Council will have to vote on an agreement. He said he will support the resolution. <br />He said one negative impact is politics. He said we will learn over the year how it will <br />apply to us. Mr. Caravati said he will accept language amendments if others would like <br />to do so. <br /> <br /> Ms. Richards suggested that "said agreement to be subject to approval by <br />Council" be added to the resolution. <br /> <br /> Mr. Lynch suggested that the first paragraph read "Council expresses its intent to <br />exercise the option." <br /> <br /> Mr. Schilling asked if Mr. Lynch will also support changing the second paragraph <br />as suggested by Ms. Richards, and Mr. Lynch said yes. <br /> <br /> Ms. Richards said she will support the resolution with one proviso, that Ms. <br />Kelley check with VDOT legal staff to make sure the language in the resolution is <br />adequate. <br /> <br /> Ms. Kelley s aid the language changes are consistent with letters used by at least <br />one other locality. <br /> <br /> Mr. Caravati asked that a copy of the legislation be sent to him. <br /> <br /> Mr. Lynch made a motion to approve the resolution as amended, and Ms. <br />Richards seconded the moti on. The resolution was approved by the following vote. <br />Ayes: Mr. Caravati, Mr. Cox, Mr. Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br />WHEREAS, <br />the 2003 General Assembly enacted Virginia Code §33.1 - 23.3(D), <br />allowing a city to take over the responsib ility for its transportation project construction <br />program upon the provision of notice to the Commonwealth Transportation Board prior <br />st <br />to July 1 for implementation the following year; and <br /> <br />WHEREAS, <br />this City Council desires to exercise the option afforde d by §33.1 - <br />23.3(D); and <br /> <br />WHEREAS, <br />the City of Charlottesville is a locality to which funds are <br />apportioned pursuant to §33.1 - 23.3; and <br /> <br />NOW THEREFORE BE IT RESOLVED, as follows: <br /> <br /> <br />(1)THAT the City Council hereby exercises the option afforded by §33.1 - 23(D) to <br />take over the responsibility for its construction program and hereby directs the Director <br />of Public Works to forward a copy of this resolution to the Commonwealth <br />Transportation Board prior to July 1, 2004; and <br /> <br />(2)THAT the City Council hereby authori zes the City Manager to enter into any <br />written agreements required by the Commonwealth Transportation Board or <br />Commissioner to give effect to the matters which are the subject of this resolution. <br />
