She said he is a <br />member of Buford School PTO, is a world cla ss person, very community minded, will <br />research issues, and is a very emotional intellect. <br /> <br /> Mr. Herbert Tucker, Albemarle County resident, supported Charles Morrill. He <br />said he is open minded, has depth of character, and has intellectual virtues. <br /> <br /> As t here were no further speakers the public hearing was closed. <br /> <br /> Mr. Schilling said it would be helpful for the public to know which wards the <br />applicants live in. <br /> <br />th <br /> Mr. Caravati said Mr. Bograd, Ms. Gronlund, and Ms. Gutauskas lived in the 4 <br />nd <br />ward and the r emaining candidates live in the 2 ward. <br /> <br />PUBLIC HEARING/RESOLUTION <br />: MANAGEMENT OF VDOT <br />CONSTRUCTION PROJECTS <br /> <br /> Mr. O'Connell said that under recent State law cities may assume responsibility <br />for management of VDOT construction projects. <br /> <br /> Mr. Jim Tolber t, Director of Neighborhood Development Services, said that cities <br />th <br />can opt into this program by June 30 , He said this will affect State and Federal aid, but <br />noted that roads still have to be designed to standards. He said it provides flexibility to <br />bid and procure projects ourselves and move funds from one account to another. He said <br />there are still unresolved questions, but opting in at this time will give us time to study <br />the issues further and to also look at staffing issues. <br /> <br />Mr. Schilling asked if the resolution is actually exercising the option or leaving <br />open the opportunity to do so. <br /> <br />st <br /> Ms. Kelley said that the State Code says the City shall notify by July 1 , but the <br />deal is sealed with an agreement later. <br /> <br /> Mr. Schilling asked if there is a pe nalty or a downside to opting in now, and Ms. <br />Kelley said not that she has seen or heard of any downside. <br /> <br /> Mr. Tolbert said that last year five cities opted into the program, but two later <br />withdrew with no penalty. <br /> <br /> Mr. Schilling said he would feel bette r if the resolution was changed to reflect that <br />Council must approve the agreement at a later date. <br /> <br /> Mr. Caravati asked why two cities opted out, and Ms. Judy Mueller, Director of <br />Public Works, said they had not investigated the impact, especially staff t ime, and they <br />also had too many projects in various stages. <br /> <br /> Ms. Richards said if we vote tonight to authorize the City Manager to enter into <br />the agreement she would not want it to have to be reauthorized by the next Council. <br /> <br /> Ms. Kelley said the resolut ion could be amended to authorize the City Manager to <br />explore the terms and conditions for the final agreement and to return the issue to <br />Council. <br /> <br /> Mr. Tolbert noted that the final agreement will need to be approved by Council. <br /> <br />Ms. Kelley suggested delet ing the second clause and just saying that the City is <br />exercising the option. <br /> <br /> The public hearing was opened. <br /> <br />
