She said federal funding is <br />available for the $2.5 million purchase price. <br /> <br />th <br /> Mr. Brown said the agreement before Council is the one dated June 18 . He <br />asked that the agreem ent be amended on page 7, paragraph 9.2 to delete "or that funding <br />is not available or appropriated." He said this is not necessary since funding is available. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Richards, the Resolution <br />Authorizing the Purchase of Property on Avon Street from Liebig Corporation, as <br />amended by Mr. Brown, was approved by the following vote. Ayes: Mr. Caravati, Mr. <br />Cox, Ms. Richards. Noes: Mr. Lynch and Mr. Schilling. <br /> <br />RESOLUTION <br />: ACCEPTING 2210 NORTH BERKSHIRE PROPERTY (BLIGHT ED <br />PROPERTY) <br /> <br /> Mr. Tolbert explained that the property at 2210 North Berkshire Road has a <br />history of flooding and was substantially damaged in July of 2003. He said staff pursued <br />the drainage program where the property owner pays 25% and the City pays 75% , but the <br />property owner walked away and the property was condemned. He said the Planning <br />Commission deemed it to be a blighted property and Council's concurrence is needed <br />with this. He said the property will be advertised and then taken down. He said the City <br />is negotiating with the mortgage company, which now owns the property, to acquire it <br />and fix the drainage. <br /> <br /> Mr. Brown said the action required is approval of a resolution confirming that the <br />property is blighted. <br /> <br /> Mr. Caravati asked if other pro perty owners were interested in participating in the <br />drainage program, and Mr. Tolbert said two agreed, and one is not really affected. He <br />said two properties will not be fixed. <br /> <br /> On motion by Mr. Caravati, seconded by Mr. Lynch, the Resolution Authorizin g <br />Proceedings for Abatement of the Nuisance of a Blighted Property Located at 2210 North <br />Berkshire was approved by the following vote. Ayes: Mr. Caravati, Mr. Cox, Mr. <br />Lynch, Ms. Richards, Mr. Schilling. Noes: None. <br /> <br />ORDINANCE <br />: REZONING MADISON AND ME ADOW STREET PROPETY TO <br />nd <br />PUD (2 reading) <br /> <br /> Ms. Missy Creasy, Planner is Neighborhood Development Services, said, in <br />response to questions raised at the last meeting, that side yard setbacks will be zero and 6 <br />feet. She said there has been agreement about the landscaped area. She said drainage <br />concerns with phase one are still being worked on with staff. <br /> <br />
