56 <br /> <br /> Ms. Hamilton questioned whether Neighborhood Development Services is the <br />appropriate monitoring group, or whether there is a more appropriate body. Regarding <br />gardening, she said there is no mention of fertilizers. <br /> <br /> Ms. Kelley said that currently pesticides are addressed. She said we are not <br />prepared at this time to monitor water quality, but we may have additional regulations to <br />propose in the future. <br /> <br /> Regarding land disturbing activity, Ms. Hamilton noted that paving, which creates <br />runoff, is not included. <br /> <br /> Ms. Kelley said the definition of land disturbing activity comes from the state, <br />and there is not much room for alteration. She said the only latitude the City has is to <br />reduce the square footage of the land affected. <br /> <br /> Ms. Riddervold said the driving goal of this ordinance is to establish a justifiable <br />and reasonable basis first, and then look at other issues and build on this. <br /> <br /> Ms. Hamilton asked if we would have to lower the square footage to 6,000 square <br />feet in order to permit monitoring of pavement. <br /> <br /> Ms. Riddervold said that under current state law paving is not considered a land <br />disturbing activity. <br /> <br /> Mr. Lynch asked what it takes to receive a certificate of competence, noting that <br />some citizens may want to do projects on their own that require this. <br /> <br /> Ms. Karen Firehock, Planning Commission member and member of the <br />committee that worked on the ordinance, said that she has received the certificate of <br />competence and it required taking a workshop, becoming familiar with the State Code, <br />and passing a test. <br /> <br /> Ms. Riddervold said that there is a higher level of training required for staff and <br />inspectors. She said the certificate is only needed for the erosion and sediment control <br />plan. <br /> <br />Mr. Lynch expressed concern with the amount of training for individual citizens. <br /> <br />Ms. Kelley said this does not really apply to citizens. <br /> <br /> Ms. Hamilton said she thinks the public should have another opportunity to weigh <br />in on this ordinance. She said she is not comfortable with having NDS as the agency <br />charged to monitor it. <br /> <br />Ms. Riddervold said she is not aware that another department is set up to do this. <br /> <br />Mr. Lynch echoed Ms. Hamilton's concern. <br /> <br /> Ms. Kelley said that the permits are all tied into the site plan approval which is <br />done in NDS. She noted that there is joint oversight in Public Works. <br /> <br /> Ms. Hamilton said this could create significant new work in NDS for existing <br />staff. <br /> <br />Mr. Riddervold said this is already part of their workload. <br /> <br /> Mr. Lynch said he feels this is a good ordinance, but there is a lot of unfinished <br />business and only the first step.
