57 <br /> <br />PROTECTION ORDINANCE" was offered and carried over to the next meeting for <br />consideration. <br /> <br />It was agreed that an additional public hearing would be held at the next meeting. <br /> <br />ORDINANCE: CLOSING CLEVELAND AVENUE <br /> <br /> Mr. Dan Clark, Engineer in Neighborhood Development Services, said that the <br />Planning Commission approved closing the street on a five to two vote. He said a large <br />sanitary sewer project is going to occur in this location next year and the City needs <br />access to the line and room for construction staging. He said that the property owner has <br />offered to address all of staffs concerns, and all of the objections have been addressed. <br /> <br /> Mr. Lynch asked what Mr. Clark's confidence level is that the project will get <br />done in three years. <br /> <br /> Mr. Clark said that the survey is going on now and construction is scheduled from <br />March to September. He said funding is available, but engineer work still has to be done. <br />He said he is 99% sure that the project will be completed in three years. <br /> <br /> Mr. Schilling said he appreciates the tour of the property with Mr. Clark. <br />Regarding consistency, he said that Mr. Clark believes that the value of the construction <br />staging is more valuable than the amount we would get for the land. <br /> <br /> Mr. Clark said it is difficult to quantify, but said Charlottesville is a difficult place <br />to work. He said a large area has been identified for construction staging, and it is worth <br />several tens of thousands of dollars. <br /> <br /> Mr. Schilling said that if that estimate is even in the ballpark he feels it is worth it. <br />In order to be consistent, he said he would like to add a clause to the ordinance noting <br />that consideration was given to the value of the construction staging, and Council <br />considers it to be a greater or equal value to what would be charged. Mr. Schilling said if <br />this were not the case, he probably would have sided with the minority on the Planning <br />Commission. <br /> <br />Dr. Brown said Mr. Schilling's point is well taken. <br /> <br /> Ms. Hamilton noted, regarding the consistency issue, that she was not in favor of <br />charging Mr. Atkins for the Castalia Street closing. <br /> <br /> Mr. Brown said the amount of property involved has been adjusted and the new <br />figure is 12,887 square feet, and said that the motion should reflect this. <br /> <br />Mr. Clark noted that this amount will be adjusted again after the survey. <br /> <br /> Mr. Schilling made a motion to approve the ordinance, with the square footage <br />provided by Mr. Brown, with language to be added by the City Attorney to include the <br />fact that Council received valuable consideration for the land being conveyed by getting <br />an agreement which allows construction staging to take place on the property. Mr. Lynch <br />seconded the motion <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING A PORTION OF CLEVELAND AVENUE BETWEEN PARCELS <br />31, 32, AND 33 ON CITY TAX MAP 22B(716, 718, AND 720 HIGHLAND AVENUE) <br />AND PARCEL 118 ON CITY TAX MAP 2lA" was offered and carried over to the next <br />meeting for consideration. <br /> <br />APPROPRIATION: $78,000 - FRIENDSHIP COURT SPONSORSHIP DONATIONS <br />(2nd reading) <br /> <br /> Ms. Hamilton asked that more background be provided on what these funds will <br />be used for, and noted that she has heard concerns about using off-duty police in this <br />capacity. <br /> <br /> <br />
