NOTICE OF SPECIAL MEETING <br /> <br />A SPECIAL MEETING OF THE CHARLOTTESVILLE CITY COUNCIL WILL BE <br />HELD ON Monday, September 27, 2004 AT 5:00 p.m. IN THE Basement Conference <br />Room. <br /> <br />THE PROPOSED AGENDA IS AS FOLLOWS: <br /> <br />Work Session: VDOT Transportation Priority Listing <br /> <br />Application of Water Protection Ordinance to Pending Land Use Applications - <br />Reconsideration <br /> <br />BY ORDER OF THE MAYOR <br /> <br />BY Jeanne Cox <br /> <br />BASEMENT CONFERENCE ROOM - September 27, 2004 <br /> <br /> Council met in special session on this date with the following members present: <br />Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling. <br /> <br />Application of Water Protection Ordinance to Pending Land Use Applications - <br />Reconsideration <br /> <br /> Dr. Brown said that Council had to make a decision about the implementation <br />date of the water protection ordinance at the last minute and he has reflected on this <br />decision since that time. He asked Mr. Tolbert to talk about projects in site plan review <br />with complete applications. <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, explained that <br />there are two submittal dates for site plans each month, the 15th and 29th. He provided a <br />listing of site plans received by September 15th, but said he does not know definitely <br />which ones would be affected by the ordinance, though it is likely that at least three <br />would be affected by the stream portion and eleven by the storm water portion. He said <br />that the site plan for the Hydraulic Road site was submitted on September 19th and had <br />five deficiencies. <br /> <br /> Responding to a question about Mr. Caravati about tradition, Mr. Tolbert said that <br />in the past any site plan received were not covered by ordinances adopted after they were <br />received. <br /> <br /> Mr. Caravati asked if there have been any deviations from this tradition, and Mr. <br />Brown said none that he is aware of. <br /> <br /> Dr. Brown asked for Mr. Tolbert's understanding of which site plans met the <br />deadline by the date of the adoption of the ordinance, and Mr. Tolbert said all those on <br />the listing provided and the Hydraulic site. <br /> <br /> Mr. Caravati asked Mr. Tolbert if he sees any reason to change this tradition, and <br />Mr. Tolbert said that is up to Council. <br /> <br /> Responding to a question from Mr. Lynch about the Hydraulic Road site plan <br />deficiencies, Mr. Tolbert said the storm water calculations were not submitted, though it <br />appears they were done. He said other deficiencies were minor. <br /> <br /> Mr. Lynch asked if these site plans would be rejected and resubmitted, but Mr. <br />Tolbert said the plans would not have to be rejected. He said staff would typically call <br />and ask for the information before plans are rejected. <br /> <br /> Mr. Lynch said he feels there are grounds not to accept the Hydraulic Road site <br />plans because of the deficiencies, but the other site plans could be accepted. <br /> <br /> <br />
