NOTICE OF SPECIAL MEETING A SPECIAL MEETING OF THE CHARLOTTESVILLE CITY COUNCIL WILL BE HELD ON Monday, September 27, 2004 AT 5:00 p.m. IN THE Basement Conference Room. THE PROPOSED AGENDA IS AS FOLLOWS: Work Session: VDOT Transportation Priority Listing Application of Water Protection Ordinance to Pending Land Use Applications - Reconsideration BY ORDER OF THE MAYOR BY Jeanne Cox BASEMENT CONFERENCE ROOM - September 27, 2004 Council met in special session on this date with the following members present: Dr. Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch, Mr. Schilling. Application of Water Protection Ordinance to Pending Land Use Applications - Reconsideration Dr. Brown said that Council had to make a decision about the implementation date of the water protection ordinance at the last minute and he has reflected on this decision since that time. He asked Mr. Tolbert to talk about projects in site plan review with complete applications. Mr. Jim Tolbert, Director of Neighborhood Development Services, explained that there are two submittal dates for site plans each month, the 15th and 29th. He provided a listing of site plans received by September 15th, but said he does not know definitely which ones would be affected by the ordinance, though it is likely that at least three would be affected by the stream portion and eleven by the storm water portion. He said that the site plan for the Hydraulic Road site was submitted on September 19th and had five deficiencies. Responding to a question about Mr. Caravati about tradition, Mr. Tolbert said that in the past any site plan received were not covered by ordinances adopted after they were received. Mr. Caravati asked if there have been any deviations from this tradition, and Mr. Brown said none that he is aware of. Dr. Brown asked for Mr. Tolbert's understanding of which site plans met the deadline by the date of the adoption of the ordinance, and Mr. Tolbert said all those on the listing provided and the Hydraulic site. Mr. Caravati asked Mr. Tolbert if he sees any reason to change this tradition, and Mr. Tolbert said that is up to Council. Responding to a question from Mr. Lynch about the Hydraulic Road site plan deficiencies, Mr. Tolbert said the storm water calculations were not submitted, though it appears they were done. He said other deficiencies were minor. Mr. Lynch asked if these site plans would be rejected and resubmitted, but Mr. Tolbert said the plans would not have to be rejected. He said staff would typically call and ask for the information before plans are rejected. Mr. Lynch said he feels there are grounds not to accept the Hydraulic Road site plans because of the deficiencies, but the other site plans could be accepted.
