He said he can confirm the commitment <br />for affordable housing as made by the applicant at the previous land conveyance. He said <br />the applicant has requested that this property be conveyed at no charge. <br /> <br /> Mr. Lynch made a motion to amend the ordinance to strike the $15,000 <br />requirement as he feels there was already good faith negotiation for what we thought was <br />already the entire property. He said he feels it is unfair to penalize the applicant for an <br />oversight. <br /> <br /> Ms. Hamilton seconded the motion for purposes of discussion. Regarding the <br />affordable housing commitment done in conjunction with Piedmont Housing Alliance, <br />she asked if Southern Development will be getting the full market value for those units. <br /> <br /> Mr. Frank Bailiff, representing Southern Development, said the amount they will <br />get is capped at $150,000. <br /> <br /> Mr. Lynch's amendment was approved by the following vote. Abstaining: Mr. Schilling. <br /> <br /> The ordinance entitled "AN ORDINANCE AUTHORIZING THE <br />CONVEYANCE OF CITY-OWNED PROPERTY (5TM STREET RESIDUAL RIGHT- <br />OF-WAY) TO SOUTHERN PROPERTY, LLC," as amended, which was offered at the <br />December 6th meeting, was approved by the following vote. Abstaining: Mr. Schilling. <br /> <br />ORDINANCE: CLOSING LEANDER AVENUE <br /> <br /> Mr. Ron Higgins, Planner in Neighborhood Development Services, said that <br />questions had been raised at the previous meeting about the location of Leander Avenue <br />relative to the stream. He said that the stream protection ordinance would require any <br />trail be built away from the stream. He said closing the street would not affect access to <br />the stream, and said staffs recommendation is to close it. <br /> <br /> Mr. Caravati asked if the right-of-way extends into the 6th Street trailer park, and <br />Mr. Higgins said that was closed a number of years ago. <br /> <br /> Mr. Lynch said it is his understanding that the PUD proffer from the applicant <br />commits to money to build a bridge, and Mr. David Toscano, attorney representing the <br />applicant, said yes. <br /> <br /> Mr. Lynch said his concern is not so much who owns the creek, but how we <br />preserve public access to it. He said as a general philosophy we should preserve and <br />enhance access to creeks. He suggested asking for pedestrian access in exchange for the <br />closing. <br /> <br /> Mr. Toscano said he does not think the closing affects public access to the creek. <br />He said as a matter of public policy, it makes no sense not to close the street. He said the <br /> <br /> <br />
