13 <br /> <br />suggestion was made to close the street in order to clean everything up for the <br />development. <br /> <br /> Mr. Lynch said he thinks it is reasonable that the public be allowed to have some <br />access. He said the bridge may be better at Avon rather than Rialto. <br /> <br /> Mr. Caravati said he does not particularly want to close the street, and feels there <br />is no compelling argument either way. He made a motion to lay the request on the table. <br />He said if he is forced to vote, he will vote against the closing. <br /> <br />Dr. Brown said no public good will be achieved by laying the request on the table. <br /> <br /> Mr. Lynch suggested that the street be closed subject to an easement with Rivanna <br />Trails which would be cleaner for the developer. <br /> <br /> Mr. Caravati made a motion to deny the closing, and Mr. Schilling seconded the <br />motion, saying that not having heard any compelling argument to close it, he feels it <br />should be kept open. <br /> <br /> Dr. Brown noted that the Planning Commission and staff recommended closing <br />the street and he has heard no reason to keep it. <br /> <br /> Mr. Lynch made a substitute motion to close the street subject to negotiation by <br />the applicant with Rivanna Trials for an easement on the north side of the creek, and Ms. <br />Hamilton seconded the motion. <br /> <br />Mr. Schilling asked about the practicality of the motion. <br /> <br />Mr. Brown said he does not know if the property owner is willing to do this. <br /> <br />Mr. Toscano said that the applicant gets no value in the closing of the street. <br /> <br /> The substitute motion was approved by the following vote. Ayes: Dr. Brown, <br />Ms. Hamilton, Mr. Lynch. Noes: Mr. Caravati and Mr. Schilling. <br /> <br /> The ordinance entitled "AN ORDINANCE CLOSING, VACATING AND <br />DISCONTINUING A PORTION OF LEANDER AVENUE BETWEEN RIALTO <br />STREET AND AVON STREET," as amended, was offered and carried over to the next <br />meeting for consideration. <br /> <br />APPROPRIATION: $68,500 - HOUSING INSPECTOR FUNDING FROM U.VA. <br /> <br /> Mr. Schilling said he had several questions for Mr. Tolbert, and was told there are <br />2000 inspections a year and an inspector's salary is $38,000 plus benefits. He asked what <br />is the cost of processing these additional inspections. He expressed concern about the <br />department being burdened and having less time to deal with complaints from other parts <br />of the City. He asked for responses by the 2nd reading of the appropriation. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Caravati, the appropriation of $68,500 <br />for Housing Inspector Funding from the University of Virginia was offered and carried <br />over to the next meeting for consideration. <br /> <br />ORDINANCE: REZONING CORNER OF PALATINE AVENUE/AVON STREET <br />FROM R- 1 S To PUD (2nd reading) <br /> <br /> Mr. Caravati said he wanted to reiterate his concerns from the previous meeting <br />and asked that Councilors who previously voted against PUDs on small lots look at this. <br />He said it does not fit into the Comprehensive Plan in terms of the neighborhood and <br />asked that Council vote against it. He noted that the Planning Commission is looking at <br />the PUD ordinance with regard to small lots. <br /> <br /> <br />
