10 <br /> <br />Schilling said he sees no compelling reason to appropriate the funds now though it may <br />not be a bad idea. <br /> <br /> WHEREAS, the Virginia Department of Transportation has allocated dollars to <br />the City of Charlottesville specifically for the Belmont Bridge and has provided <br />reconciled funds; now, therefore <br /> <br /> BE IT RESOLVED by the Council of the City of Charlottesville, Virginia that a <br />total of $1,460,000 received from the Virginia Department of Transportation is hereby <br />appropriated to account code 26-280-051693 in the Capital Improvements Program for <br />the purpose of funding repairs to the Belmont Bridge. <br /> <br />RESOLUTION: AMENDING PHA CONTRACT RE: PURCHASE OF JOHN <br />STREET LOTS <br /> <br /> Mr. Brown said that changes in the contract requested by Piedmont Housing <br />Alliance include size, range of sales price, revised schedule, target income, and <br />subordinating the interest in the properties to the construction loan. <br /> <br /> Mr. Caravati made a motion to approve the amended contract and Mr. Lynch <br />seconded the motion. <br /> <br /> Mr. Schilling said that in reviewing the information he is troubled by several <br />things, including his calculation that the loss to the City is $25,000 to $30,000 in real <br />estate taxes which could not be collected due to the three year delay in the contracted <br />marketing schedule, plus an additional $75,000 of land sale proceeds which were not <br />collected by, but contractually were due to the City. He said no one considered enforcing <br />the conditions of the contract until he called it into question. He said a policy should be <br />put into place so we either enforce these clauses or do not include them. He noted, <br />however, that he thinks there is a personal relationship between this organization and <br />Councilors and that the amended contract will be approved. <br /> <br />Dr. Brown asked if Mr. Schilling is implying that there is a conflict of interest. <br /> <br />Mr. Schilling said no, just personal relationships. <br /> <br />Mr. Brown said it is not clear why the time period elapsed. <br /> <br /> Ms. Hamilton said she was satisfied with the explanation given at the last meeting <br />and called the question. <br /> <br /> Mr. Caravati said he has a relationship with PHA because he cares about what <br />they do. He said he has visited the site and it is a very difficult one to develop. He <br />seconded the motion to call the question. <br /> <br /> Mr. Lynch asked if Mr. Schilling is proposing to declare the contract in default <br />and not sell the property. <br /> <br /> The motion to call the question was approved by the following vote. Ayes: Dr. <br />Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch. Noes: Mr. Schilling. <br /> <br /> The Resolution Amending the Contract with Piedmont Housing Alliance <br />regarding the sale of John Street lots was approved by the following vote. Ayes: Dr. <br />Brown, Mr. Caravati, Ms. Hamilton, Mr. Lynch. Noes: Mr. Schilling. <br /> <br /> BE IT RESOLVED by the Council for the City of Charlottesville, Virginia that <br />the City Manager is authorized to execute on behalf of the City the attached amendment <br />to the Contract for the sale of City-owned property on John Street to Piedmont Housing <br />Alliance, in form approved by the City Attorney. <br /> <br /> <br />
