43O <br /> <br /> Mr. Lynch made a motion to approve the special use permit as worded, and Mr. <br />Schilling seconded the motion. <br /> <br /> Mr. Caravati said he will vote against the special use permit. He said we should <br />look at the history of fraternity behavior in this area. He does the neighborhood does not <br />deserve this and he feels it threatens the area. <br /> <br /> Dr. Brown noted that the Planning Commission felt pretty good about the process <br />and he feels the applicant was thoughtful and he supports the resolution. <br /> <br /> The special use permit for 1508 Grady Avenue was approved by the following <br />vote: Ayes: Dr. Brown, Ms. Hamilton, Mr. Lynch, Mr. Schilling. Noes: Mr. Caravati. <br /> <br /> WHEREAS, Keith Woodard ("Applicant") has requested a special use permit <br />with respect to property identified on City Tax Map 5 as Parcel 75 (1508 Grady Avenue), <br />consisting of approximately 0.5370 acres ("Subject Property"), to authorize use of the <br />property as either: (i) a boarding house, or (ii) a boarding, fraternity and sorority house; <br />and <br /> <br /> WHEREAS, the Subject Property is zoned "R-UMD" (University Medium <br />Density District), where, pursuant to Section 34-420 of the City Code, "boarding house" <br />and "boarding, fraternity and sorority house" are allowed only by Special Use Permit; <br />and <br /> <br /> WHEREAS, a joint public hearing on this application was held before the City <br />Council and Planning Commission on September 13, 2005, following notice to the public <br />and to adjacent property owners as required by law; and <br /> <br /> WHEREAS, on September 13, 2005, based on the information presented by <br />Neighborhood Development Services staff as well as by the Applicant, the Planning <br />Commission recommended that the application be approved as submitted, subject to <br />certain recommended conditions; and <br /> <br /> WHEREAS, this Council finds and determines that the Applicant's requested <br />uses (i) will be in harmony with the purposes and intent of Article I, Division 8 of the <br />City's zoning ordinance and of the R-UMD zoning district; and <br /> <br /> WHEREAS, this City Council finds and determines that granting the requested <br />Special Use Permit would be consistent with the City's zoning ordinance and the criteria <br />generally applicable to special use permits under Chapter 34 of the City Code; now, <br />therefore, <br /> <br />BE IT RESOLVED by the Charlottesville City Council that: <br /> <br />(1) A special use permit is hereby granted to allow the Subject Property to be used as <br /> either a boarding house or a boarding, fraternity and sorority house; and <br /> <br />(2) <br /> <br />There shall be no more than twelve (12) bedrooms located on the property - up to <br />ten (10 bedrooms in the main building and up to two (2) additional bedrooms <br />(one per unit) in the accessory structure located to the rear of the Subject <br />Property; and <br /> <br />(3) The footprint of the main building shall not be expanded. <br /> <br />PUBLIC <br /> <br /> Mr. Peter Kleeman, 407 Hedge Street, noted that a consultant has been approved <br />for the Meadowcreek Parkway interchange, and he asked for clarification about whether <br />Council has to approve contracts and who will be managing the project. He said he is not <br />aware of staff having this expertise. He said as a federal project the public is supposed to <br />take part, and selection of the consultant is of importance to the public.
