481 <br /> <br />an early work session with the School Board to talk about budgeting and what will be <br />driving their budgets in future years. <br /> <br />Ms. Hamilton agreed. <br /> <br /> Mr. Schilling said that to the extent that we have a policy about not spending <br />money on new things, he does not think the policy has worked well and thinks we need to <br />revisit it. <br /> <br />Action on the budget guidelines and calendar was deferred to the next meeting. <br /> <br />ORDINANCE: VENDOR AND SIDEWALK CAF~ AMENDMENTS <br /> <br /> Mr. Jim Tolbert, Director of Neighborhood Development Services, explained that <br />Council held a public hearing on the proposed changes on October 17th. He highlighted <br />the changes made following the public hearing. Mr. Tolbert clarified that non-profit <br />organizations must meet appearance and space standards. He said that no changes were <br />made in the section regarding reallocation of space for cafes which was an issue of <br />concern at the public hearing. <br /> <br />Mr. Caravati asked if there is a reason caf5 fees are not being raised. <br /> <br />Mr. Tolbert said no, but that may be appropriate. <br /> <br /> Mr. Caravati said he would like to look at that in the near future, and Mr. Lynch <br />agreed. <br /> <br /> Regarding certificates of appropriateness, Mr. Schilling said that in the past non- <br />profit organizations were exempt, and asked if they are now required to get one. <br /> <br />Mr. Tolbert said yes for appearance, but they are not charged a fee. <br /> <br />Mr. Lynch asked if it is possible to not have the certificates displayed by vendors. <br /> <br /> Mr. Tolbert said requiring that the certificates be displayed has been a major help <br />for enforcement and the Code requires that they be displayed. <br /> <br />Mr. Lynch asked if it is possible to do something more subtle. <br /> <br /> Mr. Tolbert said that the ordinance proposes that cafes with more than 800 square <br />feet can have their space reduced to 800 square feet if another caf~ wants to locate in that <br />area. <br /> <br /> Mr. Lynch said he thinks a better way to deal with this issue is to charge increased <br />rent for the caf~ spaces. <br /> <br /> Ms. Hamilton congratulated Mr. Tolbert for doing an excellent job of making <br />sense of this issue. She said she is not against raising vendor rates to the ceiling, but feels <br />it should be done in a phased in manner. She said her objection was to a swift, overnight <br />increase. <br /> <br /> Mr. Caravati pointed out additional cafes that need to change their barrier in order <br />to comply with the ordinance. <br /> <br /> Mr. Tolbert said the intention was not to take out the cap of 800 square feet for <br />cafes. <br /> <br /> Mr. Schilling asked if Mr. Tolbert is saying that we will no longer allow anyone <br />to have over 800 square feet. <br /> <br /> Mr. Tolbert said that provision applied to new cafes only, and said the section <br />appears to have been inadvertently struck. <br /> <br /> <br />
