482 <br /> <br /> Mr. Schilling asked on what basis will space be reallocated, and if it will be done <br />on a proportionate space based on inside space. <br /> <br /> Mr. Tolbert said it would not be done based on indoor space. He said if Council <br />is not comfortable with reallocating space, this section could be struck. <br /> <br /> Mr. Caravati said we should think about assigning of space. He said if the <br />"pioneering" cafes are sold, they would no longer be pioneering businesses. <br /> <br />Mr. Lynch said he thinks the issue would be moot if we charged more for rent. <br /> <br /> Ms. Hamilton said the reallocation issue needs more discussion, but she is okay <br />with the rest of the ordinance. <br /> <br /> Dr. Brown said he is reluctant to take away space, but feels that space could be <br />reallocated if a business is sold and someone comes in and wants space. <br /> <br /> Mr. Tolbert said the ordinance could be amended on second reading by changing <br />the reallocation of space section and increasing rent for cafes. <br /> <br /> On motion by Ms. Hamilton, seconded by Mr. Caravati, the ordinance entitled <br />"AN ORDINANCE TO AMEND CHAPTER 28 OF THE CODE OF THE CITY OF <br />CHARLOTTESVILLE (1990), AS AMENDED, TO REVISE REGULATIONS <br />APPLICABLE TO STREET VENDORS AND THE OPERATION OF OUTDOOR <br />CAFES" was offered and carried over to the next meeting for consideration. <br /> <br /> Council requested that a public hearing be held at the next meeting on the <br />proposal to increase caf~ rents. <br /> <br />ORDINANCE: REZONING 625 MONTICELLO ROAD AND 709 SONOMA <br />STREET FROM R-1S TO B-1 <br /> <br /> Mr. Brian Haluska, Planner in Neighborhood Development Services, said that the <br />applicant has removed the request to rezone 702 Sonoma Street, her residence, from the <br />application. He said the owner has also verbally guaranteed that she will not demolish <br />any of the structures as long as they are part of the business. <br /> <br />Mr. Caravati said he is more satisfied with this proposal. <br /> <br /> Ms. Hamilton said she was not able to visit the neighbors about this proposal, but <br />will do so prior to the second reading. <br /> <br /> On motion by Mr. Lynch, seconded by Ms. Hamilton, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REENACTING THE ZONING DISTRICT MAP <br />INCORPORATED IN SECTION 34-1 OF THE ZONING ORDINANCE OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1990, AS AMENDED, BY TH4E <br />REZONING OF PROPERTY LOCATED AT 709 SONOMA STREET AND 625 <br />MONTICELLO ROAD FROM R-1S RESIDENTIAL TO B-i" was offered and carried <br />over to the next meeting for consideration. <br /> <br />ORDINANCE: REZONING CORNER OF AVON STREET AND PALAT1NE <br />AVENUE FROM 4-1 S TO PUD <br /> <br /> Mr. Haluska said that the developer has promised in writing to provide two <br />affordable units in conjunction with this rezoning request at a net mortgage value of <br />$135,000. <br /> <br /> Mr. Haluska was asked if this covenant will convey if the property is sold, and <br />Mr. Haluska said no. <br /> <br />Mr. Caravati said it would be nice to have this in the form of a proffer. <br /> <br />Ms. Hamilton asked about the chances of getting a proffer. <br /> <br /> <br />
