483 <br /> <br /> Mr. Tolbert said the rezoning process would have to start over in order to have a <br />proffer. He said this letter is probably as enforceable as a proffer. <br /> <br /> On motion by Mr. Lynch, seconded by Mr. Caravati, the ordinance entitled "AN <br />ORDINANCE AMENDING AND REENACTING THE ZONING DISTRICT MAP <br />INCORPORATED IN SECTION 34-1 OF THE ZONING ORDINANCE OF THE <br />CODE OF THE CITY OF CHARLOTTESVILLE, 1990 (AS AMENDED), BY THE <br />REZONING OF PARCEL 373, CITY TAX MAP 59 FROM R-1S TO PUD" was offered <br />and carried over to the next meeting for consideration. <br /> <br /> Mr. Caravati noted that he was taken aback and embarrassed at the last Planning <br />Commission by the treatment of Mr. Haluska and Mr. Tolbert by the temporary chair of <br />the Planning Commission. <br /> <br />ORDINANCE: WATER PROTECTION STATUS REPORT AND ORDINANCE <br />AMENDMENTS <br /> Mr. Tolbert gave a status report on water protection sites. He said that the <br />ordinance needs to be amended to include enforcement mechanisms. <br /> <br /> Mr. Caravati asked if the civil penalty of $2,000 is the statutory limit. He said if it <br />is not, he would like to take it to the maximum amount. Mr. Caravati said that the <br />ordinance refers to fining a "person," but said more often than not it is not a person that <br />should be fined. He asked if the fines go to the general fund. <br /> <br />Mr. Brown said yes, the fines go to the general fund. <br /> <br /> Mr. Caravati suggested considering putting the money back into enhancing <br />streams. Mr. Caravati asked if each violation on a property is separately fined. <br /> <br /> Mr. Tolbert said that staff attempt to get developers to comply before penalizing <br />them. He said if that fails, the penalty is as high as possible. <br /> <br /> Mr. Caravati said his concern is that only disturbances over 6,000 square feet <br />qualify, but a lot of development is under that amount. He said we should give some <br />thought to applying the ordinance to below 6,000 square feet. <br /> <br />Mr. Tolbert said this could be the limit allowed by the State, but he will look into <br /> <br />it. <br /> <br /> Mr. Lynch expressed concern about there being enough of a definition in Section <br />10.51 and said he would like to see more clarification. <br /> <br />Mr. Brown said that the design manual could be referenced in the ordinance. <br /> <br /> Dr. Brown asked if staff anticipate a move toward including smaller properties, <br />and Mr. Tolbert said he can investigate that. <br /> <br /> Dr. Brown said he would like to define more how we can get quality as well as <br />quantity. <br /> <br /> On motion by Mr. Caravati, seconded by Ms. Hamilton, the ordinance entitled <br />"AN ORDINANCE AMENDING AND REORDAINING CHAPTER 10 AND <br />CHAPTER 31 OF THE CHARLOTTESVILLE CITY CODE, 1990, AS AMENDED, <br />RELATING TO WATER PROTECTION AND EROSION ISSUES" was offered and <br />carried over to the next meeting for consideration. <br /> <br />APPROPRIATION: $150,000 - PIEDMONT HOUSING ALLIANCE HOUSING <br />TRUST FUND <br /> <br /> Mr. Tolbert explained that staff was approached by Piedmont Housing Alliance <br />about the use of HOME funds to help capture additional funding for their Housing Trust <br />Fund. He said these funds were established for our down payment assistance program. <br />He said the City has to spend the repayment income before it can spend new funds. He <br /> <br /> <br />
